Judge Orders Search of Administration Appointees' E-Mails

    With Bush administration White House aides on their way out the door in coming days, a federal judge this morning ordered the president's executive office to undertake a comprehensive search for millions of senior appointees' e-mails that have been inaccessible and possibly missing since 2005.

    The order reflects a continuing effort by outside groups to ensure that the White House transfers historically significant materials to the National Archives on or before next Tuesday, as required by federal law. District Court Judge Henry H. Kennedy Jr. demanded that officials search computer workstations, preserve thumb drives and examine e-mail archives created or retained by White House employees from 2003 to 2005, the period in which a records gap exists.

    The Justice Department had argued the order was unnecessary because efforts are underway to retrieve any missing e-mails from tapes that periodically copied everything on White House computer servers as a precaution against an electronic disaster. But the two plaintiffs, a historical research group called the National Security Archive and a nonprofit organization called Citizens for Responsibility and Ethics in Washington, have complained that the White House has not disclosed the status of those efforts.

    The dispute was provoked by the disclosure three years ago that the White House, in switching to a new internal e-mail system shortly after Bush's election, abandoned an automatic archiving system meant to preserve all messages containing official business. Under the new system, any of the 3,000 or so regular White House employees could access e-mail storage files, enabling them to delete messages after they had been created.

    An internal White House report noted in 2005 that e-mails appeared to be missing from specific periods, including key moments related to the invasion of Iraq and to a federal probe of the leak of Valerie Plame's employment by the CIA. But White House officials have since said that some of the e-mails from those periods have been retrieved.

    Gary Stern, general counsel of the National Archives and Records Administration, said last month that "we hope and expect" that all the e-mails can be recovered soon, but said he was unsure whether they would be.

    "We are reviewing the court's order and will comply with the law," said White House spokesman Scott Stanzel. "We have made great progress in the accounting of e-mail messages."

    A court hearing on the issue is scheduled for later today.

This is really amazing. On the one hand, Bush ignores FISA laws to tap all internet traffic from overseas and gives it to the NSA, capturing the world's private communications for surveillance. On the hand, his own administration's emails go 'missing'? Hypocrisy reaches new depths.

Amazing? To be expected,

Amazing? To be expected, I'd say. Who is George Bush? He is the son of former head of the CIA and later president George Bush, Sr. He is the grandson of Nazi-collaborator Sen. Prescott Bush. These are people who for generations hence forth should be prohibited from higher office. For one thing, the nation should take measures to assure that no former head of the CIA is ever allow to become president. The CIA is an agency dedicate not only to secrecy but also to deceit, murder, subversion, fabrication, etc. What has gone on with this Bush just as with the first Bush is not hypocrisy, it is not cynicism, it is not malfeasance . It is a mentality, a world view, an ideology pushed relentlessly and with disasterous consequences for the planet and for humanity. This is a family whose reign in power must end for good on January 19. Period. May the Spaniards or some other nation arrest the bastard and try him for his crimes. We as a people have been fully emasculated and politically incapacitated. We are going to let him mount his helicopter, give us his murderous smile, and fly off to Dallas. Treasonous indeed. We brought him to power and we are allowing him to leave a full-term times two president. If history is honestly written it must tell of his crimes. And it must tell of a U.S. people who could not and would not stop him.

I`ve used free data recovery software that even restored deleted photos from memory cards now these people know regulatory procedure regarding every scrap of data and since only explicit portions containing clearly incriminating material have been knowingly purged from the record that is of itself de-facto evidence of a cover up which is TREASON for crying out loud when the AG failed to apply rico act to the Libby fiasco he literally dropped trou and defecated dead center on the Constitution and World Court...hell Bush should have just issued the pardons and decorated every remaining Nazi!

Michael Connell, the

Michael Connell, the mastermind behind the missing e-mails, election fraud 2000-2004 and the fired prosecuters, mysteriously died a couple of weeks ago when his small plane crashed in Ohio. He was scheduled to testify on these matters in court. He knew where the e-mails were.

It's not going to matter

It's not going to matter that much anyway. When Lockheed-Martin got the contract to create the software that manages the National Archive (Wired Jan. 2006), all hope of genuine transparency went out the window anyway. When a highly secretive military industrial corporation, the #1 exporter of arms in the world, controls the nation's documents and access to them, there's not a heck of a lot of hope that we're going to see what they don't want us to see.

Individuals responsible, ultimately the President, for the preservation of these records in accordance with the law must be penalized for failure to do so. If not, Presidents will comply only when politically convenient. These are not dressed up well enough to be pandered as mistakes. It is intentional and it is outrageous. My fear is that people will be so glad that he is gone he sill simply fall to the periphery. But we simply MUST get him for what he has done to our home and society. Otherwise, as head of a populace that will allow atrocities on a Bush Jr. scale, what president would not be tempted to moral and legal elasticity. "becomes destructive to these ends"? What are you going to do?

We "will comply with the law" as we interpret it of course, to wit, torture, habeas corpus, wiretapping, etc. I do believe Mr Stanzel underspoke himself as well. For "accounting of e-mail messages" he should have said "accounting for [the destruction] of [every] e-mail messages [we can get our grubby mitts on]." Understandable oversight, the man is in a terrible hurry.

Imagine the expanded scope

Imagine the expanded scope and substance of the high crimes, wanton misdemeanors and un-Constitutional mischief that Jeb Bush or his equal will seek to accomplish if he is ever manipulated into the Oval Office. Based upon the foundation of deceit, mismanagement, fraud, collusion and extreme secrecy established by the unpunished Cheney/Bush administration, there is no limit to which laws and sections of the US Constitution can be safely ignored. They are looking for the missing emails in the wrong place. They need to look on the computer in Tennessee where the Ohio votes in 2004 were sent. Michael Connell (GovTech Solutions) programmed the Ohio votes to go there before being reported. This site also hosts other GOP software.

Investigate the justice

Investigate the justice dept. Who squashed the investigation to locate the missing emails? That investigation needs to happen in order to move forward to find out where the missing emails are, or, find out who deleted them and covered it up.
