A Torture Report Could Spell Big Trouble for Bush Lawyers

    An internal Justice Department report on the conduct of senior lawyers who approved waterboarding and other harsh interrogation tactics is causing anxiety among former Bush administration officials. H. Marshall Jarrett, chief of the department's ethics watchdog unit, the Office of Professional Responsibility (OPR), confirmed last year he was investigating whether the legal advice in crucial interrogation memos "was consistent with the professional standards that apply to Department of Justice attorneys." According to two knowledgeable sources who asked not to be identified discussing sensitive matters, a draft of the report was submitted in the final weeks of the Bush administration. It sharply criticized the legal work of two former top officials - Jay Bybee and John Yoo - as well as that of Steven Bradbury, who was chief of the Office of Legal Counsel (OLC) at the time the report was submitted, the sources said. (Bybee, Yoo and Bradbury did not respond to multiple requests for comment.)

    But then–Attorney General Michael Mukasey and his deputy, Mark Filip, strongly objected to the draft, according to the sources. Filip wanted the report to include responses from all three principals, said one of the sources, a former top Bush administration lawyer. (Mukasey could not be reached; his former chief of staff did not respond to requests for comment. Filip also did not return a phone message.) OPR is now seeking to include the responses before a final version is presented to Attorney General Eric Holder Jr. "The matter is under review," said Justice spokesman Matthew Miller.

    If Holder accepts the OPR findings, the report could be forwarded to state bar associations for possible disciplinary action. But some former Bush officials are furious about the OPR's initial findings and question the premise of the probe. "OPR is not competent to judge [the opinions by Justice attorneys]. They're not constitutional scholars," said the former Bush lawyer. Mukasey, in speeches before he left, decried the second-guessing of Justice lawyers who, acting under "almost unimaginable pressure" after 9/11, offered "their best judgment of what the law required."

    But the OPR probe began after Jack Goldsmith, a Bush appointee who took over OLC in 2003, protested the legal arguments made in the memos. Goldsmith resigned the following year after withdrawing the memos, and later wrote that he was "astonished" by the "deeply flawed" and "sloppily reasoned" legal analysis in the memos by Yoo and Bybee, including their assertion (challenged by many scholars) that the president could unilaterally disregard a law passed by Congress banning torture.

    OPR investigators focused on whether the memo's authors deliberately slanted their legal advice to provide the White House with the conclusions it wanted, according to three former Bush lawyers who asked not to be identified discussing an ongoing probe. One of the lawyers said he was stunned to discover how much material the investigators had gathered, including internal e-mails and multiple drafts that allowed OPR to reconstruct how the memos were crafted. In a departure from the norm, Jarrett also told members of the Senate Judiciary Committee last year he would inform them of his findings and would "consider" releasing a public version. If he does, it could be the most revealing public glimpse yet at how some of the major decisions of Bush-era counterterrorism policy were made.

Mukasey... a name that has not been mentioned in weeks. How refreshing! Now that the little yes man is not running defense, let's hope the truth comes out and is dealt with. Imagine that. The Department of Justice may be back in the judicial business rather than providing cover for the executive branch and the tag-alongs in the legislative branch.

Investigate, indict, prosecute, find guilty, levy a stiff prison sentence. Bushsistas need to learn they are not a law unto themselves.

This is the first crack in

This is the first crack in the door into the illegal activities of the Bush administration. The case Bush and Cheney have built up to protect themselves , at least from US law, is based on these memos. If those attorneys wrote those memos under political pressure from above, that should be known. Maybe the attorneys will be the first ones to sing in order to keep themselves from losing their legal licenses or worse.

Citizens against

Citizens against torture...there are things you can do to advocate for justice against the torture promoters. I am a UC Berkeley alum, so I have repeatedly called UC Berkeley and told campus officials that John Yoo has no place on Berkeley faculty. We should all find out where these torture advocates are, where they work, etc., and contact their employers to express our dismay that they are giving money to war criminals. We also need to constantly tell Obama and other politicians that prosecution of Bush, Cheney, Gonzalez, Petraeus, Gates and other war criminals has to happen, as well as holding Bush and his gang accountable for all the other crimes they committed in office. You notice that Obama, Panetta, Pelosi, Reid and others have given a free pass to the criminals. Whereas the Republicans tried to destroy Bill Clinton for having consensual sex with a young woman, the Democrats don't even have the courage to go after Bush and his criminal friends for committing war crimes. They are all in bed together, and we have a corrupt fascist government. Otherwise, there would be war crimes trials and lots of other punishments of the evil ones who are spiritual bedfellows with Hitler, Staling and other monsters.

I would be worried too if I was a "so called" college educated attorney and I stated that torturing people WAS allowed according to the US Constitution and Bill of Rights. These are just the sickest people I can ever imagine running our government and they should be disbarred and locked up for the way they hijacked our system and used it purely for their own political self advancement. These people are NOT what America is supposed to idealize and hold dear. They're nothing but common criminals with no sense of morality about what is right or wrong! I have lived long enough ,

I have lived long enough , and seen enough in this country to predict that the Bushies will not be prosecuted by anybody. They have too much money and clout to let that happen. The fact that there is

The fact that there is anxiety is only a glimpse of things to come IF they actually prosecute for the war crimes that were committed. What about what impact torture had on the victims or the destruction and safety of the citizens of the United States and other nations around the world such as what we saw in Mumbai? What they did was a threat to national and world security and they should be charged to the full extent of the law and then turned over to an international tribunal. I have no sympathy. The Bush-Reagan Administration destoryed the global economy along with torture. Also, I am skeptical that we will ever see this type of justice and this infuriates me. What the Obama administration does now will show the American people if we really can have a free and just democracy, If we can change. We do not do this by forgiving and hoping these criminals will not prevail again.

We must demand Full

We must demand Full Disclosure of all of these activities of Bush's Lawyers who happened to work in the Justice Department. Sure, they were under incredible pressure -- pressure from the former "Leader" of this country to proscribe the illegal activities he and Cheney WANTED in disregard of the Constitution and the laws of this country. Just because Bush demanded that he be allowed to do illegal acts should not make them legal. My (paid) attorney does what I ask him to do, for the most part, and he will do all that he can to do things my way. Are Bush's Lawyers no different? I fully concur with most of the above. These heartless monsters who have destroyed so much MUST be brought to trial. How else can the rest of the world EVER trust us again? There's so much illegal

There's so much illegal stuff the Bush administration did that it is difficult to know where to start. My candidate would be to look at the stuff that Kenneth Blackwell oversaw in Ohio in 2004 -- counting votes behind locked doors, more votes than registered voters, voting machines deliberately withheld from urban precincts, etc. Rove seems to have been involved, but has refused to testify before a Congressional Committee. There's a RICO lawsuit pending against Blackwell now as a result of the Ohio 2004 election. It's a good place to start.

Yoo is at U C Berkeley Boalt Hall. I have written the administrator there, and asked how Yoo could be retained, when the knowledge of his "council to the President" was so illegal? Write Boalt Hall, and demand Yoo be fired. While you're at it write Stanford , and demand Rice be fired too for war crimes, and lying to go to an Illegal war. Our higher learning centers must know we don't allow scum like this to teach law, history. They are War criminals, and seditious cowards.

This article raises hopes

This article raises hopes that are apparently not reality-based. John Yoo is a member of the Pennsylvania Bar, which assured me in a 3-page letter in May 2008 (see http://www.snewcomb.net/yoo/killion-yoo-response.pdf) that nobody should expect the Pennsylvania Bar to take any disciplinary action against Yoo. Paul J. Killion, Chief Disciplinary Counsel, also seemed to recommend that I not publish his letter, lest I lose immunity from civil prosecution by Yoo, I suppose for defamation of character. My Dad was a member of that Bar and he had a lot of faith in its professionalism, in the professionalism of its members, and in the rule of law. I'm glad that, being dead, he didn't have to read Killion's letter. Go ahead, take a look for yourself.

In response to Mr. Larry Milton, above: America has become a christian nation. It was founded on separation of church and state along with a solid repudiation of christianity. "The United States is in no sense founded upon the christian doctrine"; Article 11, Treaty of Tripoli passed by congress 1797. "People of the Book" (old testament), Jews Christians, and Muslims, are responsible for over 90% of world religious violence today and for several thousand years past. Christians prosecuted the last witch trial in 1952. The worst holocaust of all time was the 550 years of the inquisition. Let us hold the followers of monotheism accountable for these ongoing crimes against humanity. There is only one reason

There is only one reason that Yoo and Rice and former president Bush and the other horrible members of the Bush administration live freely and happily in our society, and that reason is that the American people allow it. This should not be. This makes ordinary American people as guilty as the criminals. The Bush administration should be officially investigated, and the Department of Justice report is an excellent attempt to do that, and the American people should loudly support it.

You don't have to wait for the squeamish Justice Department officials to act. Every citizen has a right to complain to the various state Bar Association and state court system Ethics Committees demanding a disbarment investigation be commenced to see whether ethics have been violated and whether the lawyers like Yoo are fit or competent to practice. It doesn't matter whether the acts took place in Washington D.C. and Yoo is currently in California. What matters is whether he committed any illegal, unethical, or incompetent acts any where at any time. Inquire today and help get these miscreants' licenses revoked. I am glad someone is paying

I am glad someone is paying attention, but I have no faith that this report will lead to justice. Let's face it, the laws in our country only apply to us lessor citizens. Karl Rove committed treason and escaped justice by legal hairsplitting. Now he is writing for this publication. George Bush lied us into a war and the media is ignoring it because they were complicit in echoing lies they didn't bother to fact check. We could have accountability from our leaders, but a free press is part of the balance of power, and when the press is party to the corruption, there is no one to protect us. No one is going to do anything about this. The "watchdog" is sleeping with the burglar and the first amendment is reduced to protecting the right of rappers to record obscene lyrics. Fear the law because you will face the consequences in direct proportion to the money you can pay out to escape justice. But respect for the law comes only through it representing justice. When will everyone realize

When will everyone realize that Washington, District of Columbia is NOT part of the United States of America. The laws which Washington governs by do not apply to the other fifty states. Each state is actually an entity to its' own. It is only the Constitution, which is actually a mortgage document relieving the founding fathers of all liability after the war for independence and the 'Declaration of Independence', which ties the debt to the states which signed on the dotted line. Before the constitution, each state was free to its' own affairs. The 'corporation of the United States', which many of you have heard before, was set up to discharge this mortgage with Britain and France for the war debt. So then does any corporation have any loyalty to anyone except the shareholders. It only spirals down from there with each new amendment and addendum over the decades and centuries. Law, yes, but corporate admiralty equity law. Law of the sea. The admiral is the man on the ship. Any mutiny and you will pay dearly. Do not rock the boat. Ring a bell! Commander in Chief. Common law is the law of the land. We lost that between 1783 and 1787. Any good businessman would do the same, don't ya think?

It disturbs me to no end

It disturbs me to no end that John Yoo is teaching law at one of the most liberal Universities in the country. I've wanted to read from maybe one of his students what they think of him and what is he teaching them. I wonder if it includes "How to circumvent everything in the Constitution of the United States." I have a feeling that Yoo may be a smart man but probably a weenie and was taken in or swayed by some of the evil forces like Cheney and Rummy and Addington and went along. I can't remember why he left his employ with the BushReichs.

At least these former Bush lawyers will not be subject to torture by water boarding to find out who told them that physical torture 'just short or major organ failure" was not cruel and unusual and what they knew about secret CIA kidnappings, false imprisonment and undisclosed locations and when they knew their 'legal opinions' fundamentally violated the US Constitution.

Who paid Stanford and UC Berkeley and several other "prestige universities" to take in the masterminds, aiders and abettors of the most criminal of all US administrations? And what parent, in his or her right mind, would encourage (and support) a son or daughter to attend one of those gold-sucking institutions?If Rice and Yoo and . . .are helping in any way to form the minds of tomorrow's best and brightest, God help us all!!!!!

The people of this country need to stand up and say when behavior is not humane or acceptable. We always wonder what it was like to live under the rule of tyrants. Now we know. I remember looking at the people in photographs of Hitler's staged rallies. I always thought how strange to stand up and hail a sociopathic murderer. The Powers that be have just shifted their domination on the Middle East through Israel. These powers represent the same shadow government that has ruled over America. Their goals remain the same and they will try to pull America back into a full scale war in the middle east by demanding total unquestioning loyalty to Israel. To question any of this is the current ultimate taboo. It's manipulation and we have to get to the bottom of what has happened in America the last 8 years so we can finally put a stop to the Elite enriching themselves through these horrid wars that are staged to feed their unending wealth. They have been forcing wars on the people then supplying goods and weapons to both sides for centuries. We cannot allow these ruling families to sacrifice us this way any longer.
