Progressive Congressional Candidate's Fundraiser Raided by Police

    Encinitas - Francine Busby says she will demand an explanation from the Sheriff's Department about deputies breaking up a fundraising party held for her in Cardiff and arresting the host.

    The party was Friday night in the 1300 block of Rubenstein Avenue, the home of Shari Barman, a Busby supporter.

    It ended with Barman, 60, being arrested and jailed on suspicion of battery on a peace officer, and resisting, delaying and obstructing a peace officer.

    Pam Morgan, 62, a Rancho Santa Fe resident and one of the guests, also was arrested and taken to the Encinitas Sheriff's Station, where she was cited for resisting, delaying and obstructing a peace officer.

    Other partygoers were doused with pepper spray, and seven deputies, a sergeant and a helicopter were dispatched to the neighborhood of expensive homes.

    Busby, Barman, guests at the party and a Sheriff's Department spokesman provided varying accounts of what happened.

    Busby, 58, a Democrat seeking the 50th Congressional District seat in 2010, said she will meet with Sheriff Department officials today to find out who made what she called a "phony" noise complaint.

    The Sheriff's Department received the complaint at 9:33 p.m. from a man who said someone was talking on a loudspeaker and a crowd was cheering, keeping him awake.

    >From about 8 to 8:30 p.m., Busby said, she used an amplified microphone to talk to guests, whom she described as middle-aged supporters.

    During Busby's speech, Barman said in a statement yesterday, a man on the property behind her house shouted "disparaging remarks" about Busby and gay people. Barman lives in the house with her partner, Jane Stratton, 55.

    After her talk, Busby said, people chatted.

    "It was a quiet home reception, disrupted by a vulgar person shouting obscenities from behind the bushes," Busby said.

    Neighbors on three sides of the house said yesterday there wasn't much noise from the party. One man said he slept through it.

    "We didn't hear anything until the sheriff came, with eight patrol cars and a helicopter," said Natasha Cortina, 43, who said she and her two children were home with the windows open.

    Hugh Elliott, 53, who lives closest to the house, said he heard a deputy's radio, then arguing, coughing, crying and finally everyone spilling outside as the smell of pepper spray drifted over his back fence.

    Deputy Marshall Abbott, who has worked for the department for about two years, was sent in response to the noise complaint, said Sgt. Thomas Yancey of the Encinitas station, which serves Cardiff. A member of the department's psychiatric emergency response team, who was riding with Abbott that day, went with him. Abbott could not be reached for comment.

    While trying to deal with the complaint, guests at the party surrounded Abbott and he felt threatened, Yancey said.

    "We don't like people standing behind us - we have Tasers, guns, clubs," he said.

    Busby said no more than 30 people were still at the party. Yancey said deputies' reports indicate there could have been as many as 50.

    When Abbott arrived, Yancey said, he told Barman about the complaint, and she uttered an expletive about a neighbor. Abbott asked Barman for her birth date so he could issue a noise warning, but Barman refused to give it, he said.

    Barman tried to walk away, Yancey said, and Abbott grabbed her. The guests took Barman away, and Abbott used pepper spray on them. In the chaos, someone kicked the emergency response team member, a woman who is 5-foot-2, Yancey said.

    "He was pepper-spraying the faces of anyone who tried to talk to him," Busby said. "People were stunned. It was something that none of us has experienced."

    In her statement, Barman said she asked the deputy why he needed her birth date, because he knew her name and where she lived.

    "He told me I was under arrest, grabbed my right arm, twisted it behind me and threw me on the ground," she said.

    When Stratton asked the deputy to be careful because Barman had shoulder surgery recently, the deputy "knocked her to the ground," Barman said.

    After the pepper spray was used, the crowded backed off, and Abbott saw Barman in the kitchen and grabbed her, Yancey said. A man held on to Barman's foot to prevent her from being taken out of the room, and she fell to the floor. Abbott took out his Taser, the man backed off, and Barman was arrested, he said.

    At some point Abbott called for backup and six deputies and a sergeant responded, Yancey said. Deputy Derek Sanders arrested Morgan, he said. There were no reported injuries.

    Reports from deputies at the scene do not mention alcohol, Yancey said, which indicates people at the party were not suspected of being drunk.

    "The place got out of hand," he said. "If Francine Busby was there, why not take a leadership role, step up, and nip this thing in the bud?"

    Busby said she couldn't intervene because the deputy was using pepper spray on people indiscriminately.

    Barman was booked into jail at 2 a.m. Saturday and released on her own recognizance at 11 a.m., a jail official said. She is scheduled to appear in Vista Superior Court on Aug. 11 on the two misdemeanor counts.

    Morgan could not be reached for comment.

    Busby had sought the 50th Congressional District seat in 2006, but was defeated by Brian Bilbray, 53 percent to 44 percent. The seat was vacated by former Rep. Randy "Duke" Cunningham, who is in federal prison after pleading guilty in a corruption scandal.

Responding to a noise complaint with eight patrol cars AND helicopter?!! What the... When is this recognized as "police state?"

Sim0ply more of the same. Remember the Repugnican's actions at their national convention and the informants they snuck into the different organizations who intended to peacefully protest the Bush Administration immoral actions (and the information that has come out since Obama took office just continues to justify the protesters). The arrest of journalist Amy Goodman, who was a liberal. The Gestapo Tactics of those Republican continue to take an undemocratic slant. San Diego is just one more example. How about all the Republicans against people voting, like the guy in Greenville County SC who said that college students voting here would lose their scholarships and that kind of crap. Republican Repression is simply redundant.

Thank God the Republicans haven't succeeded in taking away the civil rights which are there to protect us from this, and which provide redress under such circumstances. Now I hope she gets herself a posse of crack civil rights lawyers and smokes out the real instigators, and sues everyone involved in order to make the loudest possible statement about this

The conservatives seem to

The conservatives seem to have taken over most of the police and other law-related forces, just as they have taken over most of the news media. When was the last time you heard about a right-wing group being infiltrated and disrupted or people at a Republican fundraiser being arrested? Why didn't the police try to disrupt the "tea-bagging" parties that happened earlier this year? Those were more anti-government than most liberal protests are, yet nothing ever happens to those people. Another example was when I read about a church in Southern California where the preacher was saying that war is wrong. This was near the beginning of the Iraq invasion and occupation, and the IRS told the church they had to stop saying war was wrong or they would lose their tax-exempt status. But when all those churches were giving out pamphlets and telling people to vote for Proposition 8, the anti-gay-marriage measure in California, none of those churches was warned by the IRS. I even made a complaint to the IRS about the Knights of Columbus and the Mormon Church, both of which poured many millions of dollars into a campaign filled with lies, and nothing came of it. It's actually been like this for decades, since at least the 60s, but it keeps getting worse.

Add to this a variant of "driving while black." I have long suspected that police officers halt and cite infinitely more drivers of vehicles bearing "leftist" bumper stickers, than vehicles bearing no such stickers, and even fewer times halt and cite vehicles with "rightist" ones. I personally have seen police officers give parking tickets to cars at expired meters --- passing by cars with "rightist" stickers while ticketing those with "leftist" stickers, all on the same street. Of course, data on this alleged "free speech" discrimination is not kept by any agency, presently. But, the allegation could be investigated by any competent polling organization, by asking questions like these of survey respondents. 1. Have you been halted or cited by a police office while driving? 2a. Do you have bumper stickers on your car? 2b. If yes, would you say they are "leftist", "rightist" or some mix?

The right wing thugs who

The right wing thugs who populate law enforcement agencies operate at the pleasure of their superiors and their local political political patrons. Nazis? Well, it is getting pretty hard to tell the difference. In case no one noticed, hate groups once again mushrooomed after last November's election. That's our America... land of the well armed and hateful. I can vividly remember marching in an anti-Vietnam War march that traversed Beverly Hills on Wilshire Blvd. in the early 1970s. Police were everywhere at blocked off intersections. A large group of uniformed neo-Nazis rushed the parade from two sides at one intersection, throwing buckets of paint and beating people with clubs. The police stood by for several minutes observing. However, as soon as those being attacked responded and began to prevail, Beverly Hills finest stepped in and arrested marchers but not the neo-Nazis who were easily identified by their uniforms and arm bands. Surprisingly, Beverly Hills finest had apparently left their own swastikas at home. Thugs were hiding behind authority then and they are now.

Police State Invasion

Police State Invasion Tactics are part of the perverted and frankly criminal strategies employed to terrorize any groups that might prove to be a threat to the gradual takeover of this nation by these hired mercenaries and their handlers. The beatings of little old lady peace marchers and the strip searches by uneducated TSA thugs of anyone involved in peace activities are a stark reminder of what ALL Americans are up against in this nation of secret closed door sessions of Congress and the criminalization of Constitutionally protected activities. If this attitude,including the secret FBI field guidelines that consider "anyone who mentions the Constitution" as suspect, is not punished and/or legally criminalized, then our citizens are just inmates waiting for the next beating,assault or raid by the hired thugs who have betrayed their duty to the citizens of our nation.

Did someone say that the State of California is bankrupt? It looks to me like someone doesn't like a lesbian couple in their neighborhood; but the lesbis are probably much better neighbors than whoever called the police.

It is the constitutional

It is the constitutional right and a moral obligation of all US citizens to resist unlawful acts of any public "authority" or its agents, by any means necessary. Freedom has to be actively defended at all times. Complacency and plain ignorance has led to the current degeneration of the USA today. Seems more like Nazi Germany from all the reports of police abuse. When you have strayed from principle, you need a lot of controlling laws, the playground of authoritative abuse. The police seem to believe that their job is to control situations and treat adults as children. They seem to be afraid of the people they are supposed to be serving. Then the TV glorifies all that with all the cop shows.
