Another Soldier Refuses Afghanistan Deployment

    Sgt. Travis Bishop, who served 14 months in Baghdad with the 3rd Signal Brigade, faces a court-martial this Friday for refusing to deploy to Afghanistan.

    Bishop is the second soldier from Fort Hood in as may weeks to be tried by the military for his stand against an occupation he believes is "illegal." He insists that it would be unethical for him to deploy to support an occupation he opposes on both moral and legal grounds and he has filed for conscientious objector (CO) status.

    Spc. Victor Agosto was court-martialed last week for his refusal to deploy to Afghanistan. Agosto's lawyer, James Branum, who is also Bishop's lawyer, is the legal adviser to the GI Rights Hotline of Oklahoma and co-chair of the Military Law Task Force. Branum told Truthout during a phone interview on July 10 that, contrary to mainstream opinion that believes Afghanistan to be a "justified" war, the invasion and ongoing occupation are actually in violation of the US Constitution and international law.

    "Victor is approaching this from the standpoint of law and ethics," Branum explained, "It's his own personal ethics and principles of the Nuremberg Principles, that the war in Afghanistan does not meet the criteria for lawful war under the UN Charter, which says that member nations who joined the UN, as did the US, should give up war forever, aside from two exceptions: that the war is in self-defense and that the use of force was authorized by the UN Security Council. The nation of Afghanistan did not attack the United States. The Taliban may have, but the nation and people of Afghanistan did not. And under US law, the Supremacy Clause of the US Constitution, any treaty enacted by the US is now the 'supreme law of the land.' So when the United States signed the UN Charter, we made that our law as well."

    Bishop told Truthout he was inspired by Agosto's stand and had chosen to follow Specialist Agosto's example of refusal. Both his time in Iraq, the illegality of the occupation and a moral awakening led to his decision to refuse to deploy.

    "I started to see a big difference between our reality there and what was in the news," Bishop explained to Truthout about his experience in Iraq, but went on to add that morality and religion played a role as well.

    When he received orders to deploy to Afghanistan, Bishop said, "I started reading my Bible to get right with my creator before going. Through my reading I realized all this goes against what Jesus taught and what all true Christians should believe. I had a religious transformation, and realized that all war is wrong."

    Bishop received his orders to deploy to Afghanistan in February, but at the time "didn't know there was a support network or a way out at all. I thought GI resistance was something archaic from Vietnam."

    As his deployment date approached, he met with other soldiers at a GI resistance cafe, "Under the Hood", in Killeen, Texas.

    "They told me not only do I have a choice, but I have a support network backing me up," Bishop explained, "I told them my thinking, and they said that I sounded like a CO. They put me in touch with (James) Branum and when I learned from him what a CO was, I knew I couldn't go."

    Bishop went absent without leave (AWOL) for one week the day his unit deployed, "because I didn't have time to prepare to file for CO status. So while AWOL I prepared a statement and filled out my application for CO (status). Then I went back (to Fort Hood) with Branum and turned myself in. I never planned on staying AWOL. They gave me a barracks room and assigned me to a platoon and told me to show up to work the next day. That was it. They started the CO process, but they also started the Uniform Code of Military Justice process, and that's where it gets shifty."

    Shortly thereafter, the military charged him with two counts of missing movement and disobeying a direct order.

    Bishop, Agosto, and other resisters are not alone. In November 2007, the Pentagon revealed that between 2003 and 2007 there had been an 80 percent increase in overall desertion rates in the Army (desertion refers to soldiers who go AWOL and never intend to return to service), and Army AWOL rates from 2003 to 2006 were the highest since 1980. Between 2000 and 2006, more than 40,000 troops from all branches of the military deserted, more than half from the Army. Army desertion rates jumped by 42 percent from 2006 to 2007 alone.

    Bishop informed Truthout that morale is low among his peers in the military, whether they are pro-war or opposed to the occupations.

    "Hard Corps folks, as soon as they hear about my sentence being capped at a year, they are changing their minds already," he said, "There's a lot of soldiers that go just because they feel they have to go. They are driven by money and legal obligation, not patriotism. They go because they don't want to lose their job and get in trouble. A lot of the people I talk to that are in, they feel as I do, but they say things like 'I only have four more months, so I'll ride it out and hope not to get stop-lossed.'"

    Spc. Michael Kern, an active duty veteran of the occupation of Iraq (where he served from March 2007 to March 2008), is also based at Fort Hood. He is currently getting treatment for traumatic brain injury (TBI) and post-traumatic stress disorder (PTSD).

    Kern turned against both occupations, as he told Truthout, "Once I realized it wasn't a war and was an occupation, and once I realized I was a terrorist to people in Iraq. It wasn't a hard decision. My whole unit feels as I do, but are afraid to speak out because they don't know there is support for those of us who speak out against the war."

    Kern, like Bishop, says that troop morale is very low.

    "I'd say it's at an all-time low - mostly because of Afghanistan now. Nobody knows why we are at either place, and I believe the troops need to know why they are there, or we should pull out, and this is a unanimous feeling, even for folks who are pro-war."

    Kern feels that the decisions of Agosto and Bishop to refuse to deploy to Afghanistan is worthy of admiration and support.

    "I admire these guys," he told Truthout, "They are truly amazing. I wish I would have done that, but when I deployed I didn't know what I was getting into, or my options. I look up to these guys. They are standing up for what they believe in, and that's the greatest thing any of us can do, and they are doing it despite what the Army is doing to them."

    Kern suggests that soldiers "do your research before you willingly follow orders, because this is an unjust war, and according to Army regulations, you are entitled to question an illegal order, such as deploying to an illegal war not sanctioned by the UN. And that there is a large community of support for those who are standing up. And it's all over the world, not just the US, wherever you are, there are people who feel the same way you do."

    In England, Lance Cpl. Joe Glenton, from the Royal Logistics Corps, has become the first British soldier to speak out publicly against the war in Afghanistan.

    Glenton delivered a letter to British Prime Minister Gordon Brown on 30 July stating why he is refusing to return to Afghanistan.

    Glenton wrote: "The war in Afghanistan is not reducing the terrorist risk, far from improving Afghan lives it is bringing death and devastation to their country. Britain has no business there. I do not believe that our cause in Afghanistan is just or right. I implore you, Sir, to bring our soldiers home."

    Glenton, like Agosto, and soon for Bishop, began his court-martial proceedings on 3 August.

    US commanders recently announced that US and NATO troop deaths from Afghan bombings spiked six-fold in July, compared to the same month last year. In July, resistance fighters detonated the highest number of bombs against occupation forces in the eight-year occupation, according to figures released Tuesday. More US troops were killed in July in Afghanistan than any other month of the entire occupation, and violence continues.

    Meanwhile, Anthony Cordesman, a senior adviser to the US military commander in charge of NATO forces in Afghanistan, Gen. Stanley McChrystal, told The Times of London that an additional 45,000 US troops are needed in Afghanistan.

    Bishop hopes his refusal to deploy will inspire soldiers to search their consciences.

    "My hope is that people who feel like me, that they don't have a voice and are having doubts, I hope that this shows them that not only can you talk to someone about this, but that you actually have a choice," he said.

    "Choice is the first thing they take away from you in the military," Bishop added, "You're taught that you don't have a choice. That's not true. And not wanting to kill someone or get killed does not make you a coward. I hope my actions show this to more people."

The US military has become a

The US military has become a complete disgrace to the human race!! What evil propensity have they not embraced and made part of their code? They transgress all ten commandments and the seven christian virtues! Additionally, they have forfeited any semblance of common sense and a strong case can be made about the military's collective insanity!! The US military institute alters otherwise normal young men and women, transforming them into psychotic killers and in the mythic language of Christianity they are recruited into the evil fold of the Dark Lord to do his evil bidding!! May the true God and the common sense of good people worldwide save us all from the US government and military!!!!

WOW! These guys are heroes. Imagine the courage it takes to stand up to 'The System'. It is extraordinary for Conscience to overcome the enormous energy and drive to dehumanize and control young folks to the point of doing what is actually against their own human tendencies. Thanks for this article. I like the emphasis on individual choice. So much of the fighting is about individuals following other people's one-sided directives, as though they as individuals don't have a choice. Conditioning from the cradle up does make it difficult to question one's conditioning. But this may be among our most important responsibilities. So what is this war about? Here are some of my hunches: Fear of other Lack of appreciation for other ways of being Desire for law and order Military/corporate/financial/political advantaging The need of all nations to assign an enemy for it to defend itself against Morbid curiosity Liking to take sides and to having one's own side win. The need for an intense backdrop to give mundane life something to feel relieved from Best wishes to all included.

A further comment: have other people noticed the growing gap between the military and the general society here? The US does need a reasonable sized military for self-defense. It doesn't need an imperialist military that spreads death all over the planet. The American military hasn't always been the shining "good guy" that it claims. There are decent elements in it. But it needs a complete psychological makeover and reorganization.

Unlike in Vietnam, desertion rates and the body count are completely hidden to Americans. The MSM, for example, has completely buried this huge story about the increase in AWOLs. And will this latest story about this brave CO soldier get significant press? No. First the press cooperated with the Bush Administration to keep the Iraq war going with "American support," and now they're doing the same with Obama's war. But since the MSM will not do it, WE THE PEOPLE need to tell the story of the soldier! That is all that we need to do, in greater number, with greater energy. Only then will this age of war begin to close . . .

The sad fact is that the Military Recruiters are out in full regalia, in all of the High Schools, extolling the advantages of recruitment into any branch of the Military. Most minds at that young and impressionable age will naturally be drawn to any thing that projects a belief ( true or not ) that they are Adult enough to make a Decision to Protect Their Country, and at the same time, earn money-- and in the Future, monetarily enable them to further their desire for higher education when their Enlistment is up. What they are not told is that there is a strong possibility that they may get killed ! What they are not being told is that the Military considers them dispensable, .i.e. little more than cannon fodder.

Let's not just call the military evil. War is evil. The people who send men and women into war have a lot to answer for. They might be considered evil, depending on their motives. It's time to begin a really big Peace Movement and it needs to begin with each individual person, finding peace within and letting it flow out to family, community, country and the world. We don't know how to be peaceful, but we can learn if we really want to.

Can anyone say what 'victory' in Afghanistan would look like? When you try to visualize it, you realize what folly this military enterprise is. No matter what is achieved, as soon as foreign troops leave, the country will again become whatever it naturally tends to become. The trouble with war is that its effects are so emotion-evoking that facing the fact that all the destruction and death were in vain is difficult.

Our young soldiers are now being trained like killer dogs for the lively hood of corporate America and all the neo=-conservative fascists in the USA.

Just a note of

Just a note of incouragement. Way back in '68 I refused the draft, along with probably 50,000 others at that time. It was a matter of conscience. I was told that I would receive a 2 year prison term. But I did what I had to do, knowing that the army would do what it had to do. Nothing ever happened. If enough of you young men of conscience refuse this illegal occupation the "system" may not be able to sustain their campaign of fear.

Eventually, foreign forces

Eventually, foreign forces will be withdrawn from Afghanistan, and no change to the Afghani political landscape will be apparent. Afghanistan will still not be a threat to anybody, and millions ofr surviving Afghanis will miss family and loved ones, killed in the years of slaughter, by us. Afghanistan will not ever be successfully occupied by a foreign power, just as it never has been. Afghanistan is the graveyard of empires. The fools who lack even the military prowess of the average schoolboy, but yet who commend the US military are too stupid, far to ignorant to realise that their modern army and mode4rn technological wonders of a military are yet facing the exact same difficulties that Alexander faced and that the Russians faced, just as every invading army faced. The topography of Afghanistan allows plenty of killing opportunities for both sides, although ambush has the advantage. However it does leave the opportunity for guerilla forces to remain free and hidden indefinately. How many will die before the fools in uniforms run out of options?

Only when the People sit

Only when the People sit down and refuse to fight will we have Peace on Earth. Those who make big bucks will always seek war. When all the people just sit down and say NO, and they have no osldiers/slaves to be their murderers and victims, there CAN BE peace. When there is no army to attack, there will be no need for an army to defend. Can anyone say what 'victory' in Afghanistan would look like? I suspect that it looks like the robust bottom lines of companies whose business is the manufacturing and sale of war materiel, in which case victory has already been achieved. Moreover, the 'victories' will continue, so long as troops can be kept in situations where war materiel must be expended.

Sgt. Travis Bishop and all those who refuse to fight in a war where innocent beings are being murdered, maimed and tortured are indeed heroes beyond the call of duty. Instead of choosing to face unarmed, unaware innocent women and children and to murder, rape, pillage and maimed them, they rather face the biggest threat to themselves and to humanity itself (the US military and it's corporate-bought greedy yellow liver cowards in the USA Congress) to include the Neo-conservative bible thumping-flag waving hypocrites, lying Republicans and the Neo-Nazis in America. There are enough highly paid armed chaired generals, colonels and war mongering brain-washed officers to form regiments and let them do the fighting in the stupid war of attrition the USA is famous for making and forever losing them. It makes one proud to witness real bravery of US citizens who place first their humanity and moral upbringing beyond the call of duty. These are the people that should be running the country now instead of the yellow liver greedy cowards who make money on the misery of the human race, both in the USA and throughout the world. These cowards are the real reason why the US the most hated nation in the world. Once upon a time serving the nation in the military was an honor. I worry about the young men

I worry about the young men who will eventually return home after military service. How can they possibly adjust to "normal" life when they have been trained to kill and to see everyone as an enemy? I question President Obama's decision to send even more troops into Afghanistan, particularly when many of the same troops have served in Iraq. These troops need healing, not more murder and mayhem in their lives. When they turn on ordinary citizens in the United States, will we all wonder what happened?

What exactly is it we are doing in Afghanistan? Oh, yeah, losing like every other country that ever tried this. I wish my son had refused to go to Iraq for Dick Cheney's oil. He's completely and forever blind because of the war and the VA completely hopeless health care system. He was National Guard; never could see how they could take care of the nation when it would take them 17 hours at least to return from Iraq - that's just the flight. Preparation? We are completely unprotected here at home without them.

Our men would not be over there and in danger of being killed if we had real leaders and members of Congress that had any morals at all. Our brave men are not even told what they are 'fighting and killing and dying' for. I agree that all the members of the Corporations that make fortunes off war, and all the suck-up Congress people that sell their souls for a piece of the take, and all the Armchair generals, should all be sent over there to fight for what they want..instead of sending our children to fight for them..the Bullying Cowards. All you military men will have our backing if you just sit down and refuse to go. What are they going to do...shoot you ? Follow your conscience, men. You are not obliged to fight an unjust war .. a war that has no end or purpose that is worth dying for.

I agree with the article and what many of you are saying here. I served in Iraq and the only thing that helped me to get through was indeed the guy to the right and left of me. But there can be no definitive victory. Personally, I struggle with PTSD on an hourly basis it seems, and I know that that would be considered light compared to those I served with who endured much more serious injuries. "Victory" will come at the cost of hundreds of thousands of soldiers suffering through so much more than it should be worse, not to mention the cost of civilian losses. A soldier standing up and fighting for what he morally sees is at least one small victory.

I have a question. how many

I have a question. how many of you have been to Afghanistan? how many of you have been in an armed force in this country? Im geussing vary few, if you knew anything about how these forces worked you would know about rules of engagement and the laws that we are governed by not just U.C.M.J. but also the laws of the Islamic Republic of Afghanistan and the laws of the UN and NATO now as a Deployed soldier let me tell you what these men have done is brave but it leaves us who are already hear that much weaker so then you should keep that in mind when you hear of a fallen soldier that guy who refused to do his duty could have been the one who saved the others life and BTW when I think of victory in this country I think of kites being flown without fear and this nations children being able to eat the food that they are learning to grow and store

I served with Travis Bishop in the RCF in FT Lewis. Let me tell you he is on point with everything he has explained. Is it wrong to go against a mission that does'nt even exist but lies covering more lies. Its sad to see your buddies go for a system that really has no thought to what the vision of our fore fathers of this country had. Just like me diagnosed with PTSD they want to chapter me out the Army, use me then get rid of me after almost serving 10 years. What a way to take care of your own.
