DOJ May Skirt Court Order on Interrogation Documents

    The Obama administration may circumvent the spirit of a judge’s order to disclose hundreds of documents relating to the CIA’s Bush-era interrogation program, delivering instead generic descriptions of the documents and legal arguments for continued nondisclosure.

    While the CIA inspector general’s 2004 report on torture was released Monday, a tranche of hundreds of supporting documents sought by an ongoing American Civil Liberties Union court case remain unseen. Those include 129 documents that provide some of the source material for the inspector general’s report; 138 other documents from the Justice Department’s Office of Legal Counsel about the interrogation program; and a Sept. 17, 2001 presidential order from George W. Bush authorizing the CIA to set up unacknowledged detention facilities around the world. The Justice Department released additional supporting documents earlier this week in addition to the inspector general’s report.

    On July 20, Judge Allen Hellerstein of the U.S. District Court for the Southern District of New York ruled that the government needed to complete a review of the documents for declassification in response to an ACLU Freedom of Information Act lawsuit by Monday, Aug. 31. “As to the remaining 318 remanded CIA documents, the Government shall complete its processing of those documents by August 31, 2009, such that, on or before that date, the Government shall produce to the plaintiffs any portions of those 318 documents that are appropriate for release under [the Freedom of Information Act],”Hellerstein wrote in an order filed the following day.

    But after The Washington Independent reported on the forthcoming disclosure, an administration official who insisted on anonymity emailed to say the report was inaccurate. Asked if there would be any disclosures on Monday, the official responded, “Nope.”

    Hellerstein, however, ordered in July that the government had the option of submitting a so-called “Vaughn declaration,” a FOIA term detailing, as Hellerstein wrote, legal reasons “setting forth the justification for withholding the information.” Neither the official nor the U.S. Attorney’s office in New York replied to queries about the reasons for the nondisclosure. Hellerstein’s office, which declined to comment on the record, said the judge’s ruling from July 21 was still in effect and the Justice Department had yet to file any motions to extend the deadline for disclosure.

    The ACLU and the Obama administration tussled earlier this year over a date for releasing the documents, with the Justice Department requesting and receiving four delays. In July, the U.S. Attorney’s office in New York, arguing that it couldn’t prepare any documents for declassification before Aug. 31, mused about a compromise. “The OIG report would come out August 24th, and then the remaining documents would come out August 31st,” Sean Lane, a lawyer in the U.S. Attorney’s office, told Hellerstein on July 15.

    Lane did not return an email seeking comment on Friday. A Justice Department official emailed to clarify that the agency had released a number of the documents alongside the CIA inspector general’s report on Aug. 24 on a DVD. According to the ACLU’s tally, it had received eight of 137 documents supporting the CIA inspector general’s review and 43 of 181 Office of Legal Counsel documents.

    The ACLU said late on Friday afternoon that it expected to receive a Vaughn declaration on Monday and not the documents themselves. “This past week, the Obama administration released documents that shed some much-needed light on theCIA’s rendition, detention and interrogation program,” said Jameel Jaffer, director of the ACLU’s national-security project. “Some of the most crucial documents, though, are still being withheld. The documents that the CIA is required to review for possible release by Monday would, if released, fill in some of the remaining gaps in the public record.”

    Rachel Myers, a representative for the ACLU, said the organization expects to continue litigating to receive the still-withheld documents.

What a disapppointment Obama

What a disapppointment Obama is becoming! This just shows that the total system is corrupt and politicised! No wonder the international community has written America off as a corrupt and ineffectual nation! They won't even clean up their own mess! The USA cannot be trusted to do what is morally right... It's all propaganda and BS. I pity you Americans in that there is not the political and public will to do what is needed and morally right. I guess some other nation like Spain or Germany will have to do it for you! Just like we did for Milosovic!

The Obama Administration sould not release the documents. We need to protect the CIA officers who risk their lives to preserve our freedoms. The ACLU 's well meaning suit does not take into account the people who's wall of silence have to be broken in order to keep the world a safer place for people who do not even think suicide bombing is a martyred cause. Since 9/11 the ACLU doesn't seem to realize that we are living in a very diferent world

Rest assured our government has been for decades and continues to be involved in war crimes, unspeakable covert brutalities, vicious backchannel violations of human rights, tortures, assassinations, etc. The tiny tip of the iceberg shown by the documents demanded under FOIA are just a shadow of the real world of monstrous criminals who use death and deception to advance US hegemony. From Vietnam to Nicaragua to Iraq, the USA is a force for death and tears in this poor world. Obama carries on the legacy and tradition of Bush, a puppet of the military-spy-corporate elites, and a man whose conscience will eventually turn his hair gray and darken his spirit. I feel sorry for all of us.

I do not agree with Obama on his take on interrogation. I think that we as citizens of the United States should know what the CIA has done in the name of the United States

I wonder if Obama is the end

I wonder if Obama is the end of progressive activism, the conclusion of liberal activism, the end of any enthusiasm for main stream change or veracity. Was it planned this way, to kill hope, to circumvent change? To continue the crap from past 8 years but with a smile?

Different man, different

Different man, different party, same "it's national security" excuse. Patriot Act not repealed, military commissions act not repealed and no initiative from the White House to do so. Over a hundred thousand troops in Iraq & Afghanistan. So much for immediately leaving Iraq. More military defense spending while bailing out the banksters at the expense of current & future taxpayers. Where's the change? Looks like more of the same to me, once you subtract the nicer packaging.

Did we really expect that

Did we really expect that one man could change it all? Sure,, there should be some disappointment in what Obama has done this first year,, but there are brave and concerned federal judges who are ruling that the old state secrets privilege should not deny accountability, and examination of law breaking. We will never be a nation of laws until the executive branch can be held accountable for violations of laws and treaties. The internet is truly one of the few sources of accurate information, and open debate these days. We should all reach out everyday to our friends and acquaintances with the information we have. Do we really expect a revolution to reach down from the top? It truly is time to demand accountability and transparency in government,, but this must begin with support from the people,,not suggestions trickling down from Obama. Anyone wanting to be encouraged by what one brave federal judge is doing in Washington should read some of the opinions of federal judge Royce C. Lamberth. There are people out there trying to make a difference,, there really are,, and whenever we hear of them we should do all we can to support them and encourage them. This will be the beginning of real change,,, not just an election or two. It will never be democrat versus republican,, liberal versus conservative,, Christian versus non Christian. The real issue is whether we are to become a nation of laws,, which will require the policing of the executive branch. If we can ever make this possible,, then perhaps we can be a shining light to the world,, and a participant in actions that can make peace a reality.

It is very interesting to read the comments after this article. How differently we interpret what we see and hear! What a great void there is between Heather's plea that this secrecy is needed to protect the men who were protecting us and David(I thank them for at least putting in a given name) who sees this a one more cover-up for the aggression against countries that has been done in our name and supposedly for our benefit but mainly for financial profit, oil and other natural resources. Maybe it has benefited us with worldly goods but it has built up a great resentment and anger against us in many countries . Now they fight back with any destructive act they can though it might cost them their lives. I fully support the ACLU in its effort to expose the truth, "and the truth shall make you free" John 8:32. Other countries are very eager for our good will and support but they desire to be treated honestly and as equals. Do you not recall the out pouring of sympathy immediately after 9/11?

The disappointment seems to arise in the fact that Obama didn't get it all changed by noon on January 21. That seems to have been the expectation of the self-styled Progressives who are now hedging on their support. They also seem to have believed that the opposition would vanish. It didn't -- the rabid right is more rabid and more wrong than ever, louder, more obsessive, more obstructionist, and more obnoxious (death panels, anyone?) It will therefore take time, lots of time, as well as hard work. There are no miracles. (There is a lot of hocus pocus, from all sides, but especially from the House with the next election just around the corner. And the Blue Dogs are ululating.)

Source material for a possible criminal indictment(s) but it is a national secret. What happened to transparency. Let the courts see if crimes are committed and then try those who may be guilty. Why are Bush and Cheney not already in jail for crimes against humanity? We used to talk of being a Nation of Laws -- we have LOTS of laws but enforcement is spotty and only some laws apparently apply to only some people. Just Not Right and just Not American.

As far as, Bush war crimes, Obama and his administration are making themselves culpable by continuing to cover up Bush atrocities. Obama is just another corporate puppet, who is smart enough to talk the good fight, but when it comes to action, he is missing in action. He started by reneging on his democratic primary campaign promises during the general election. You know, the conventional wisdom BS spouted off 24/7 by the corporate media and the Democratic Party. Then he waited until after the election to go into Bush mode. Obama has surrounded himself with Bush people and other corporate lackeys. He continues to following Bush policies on energy, the economy, war and health care. Do not be fooled by his superficial speeches. Obama has shown his true colors, he is a weak inexperienced politician that puts politics before people. As long as, we have a corporate lackey driven political system and media nothing will change. Meanwhile, as the Corporatist Republican Party self-destructs before our very eyes, the Corporatist Democratic Party is rushing in to fill the void.

President Obama's actions

President Obama's actions have been very disappointing for us the People thirsty for justice, decency and transparency. A web of old-guard politicians have surrounded him. The President has to define himself as the person We The People elected, not as yet another Washington politician swept up in the perks of living in the White House.

I just despise secrecy. Thank goodness for the ACLU. They are the only ones trying to keep the politicians honest. More power to them. I don't mind sending them a few bucks, as I do truthout. It's virtually certain that the secrecy is a result of the insiders trying to protect themselves from exposure from their unlawful behavior.

this issue is the indicator Progressives need to follow in determining Our future support of the Administration. If Eric Holder is allowed to pursue the criminal wrongdoing of the Bush Administration unfettered then We know We have elected a President who is really about change. We already know what the outcome of such an investigation should provide, there is no question there. If Holder meets with opposition from the Whitehouse as He begins to peel the onion, then We know for sure that Obama is just another Corporatist and We need to begin assessing Who We will support for the next run. My faith in Obama , although faltering, is still clinging to the idea that slow and steady is the way to scrutinize the scandalous Bush regime. The outcome of Holders investigation should be the indicator We follow in regards to Obama's future.
