Obama Advisers Say No Charges Likely Against Those Who Authorized Torture

    Washington - Barack Obama's incoming administration is unlikely to bring criminal charges against government officials who authorized or engaged in harsh interrogations of suspected terrorists during the George W. Bush presidency. Obama, who has criticized the use of torture, is being urged by some constitutional scholars and human rights groups to investigate possible war crimes by the Bush administration.

    Two Obama advisers said there's little - if any - chance that the incoming president's Justice Department will go after anyone involved in authorizing or carrying out interrogations that provoked worldwide outrage.

    The advisers spoke on condition of anonymity because the plans are still tentative. A spokesman for Obama's transition team did not respond to requests for comment Monday.

    Additionally, the question of whether to prosecute may never become an issue if Bush issues pre-emptive pardons to protect those involved.

    Obama has committed to reviewing interrogations on al-Qaida and other terror suspects. After he takes office in January, Obama is expected to create a panel modeled after the 9/11 Commission to study interrogations, including those using waterboarding and other tactics that critics call torture. The panel's findings would be used to ensure that future interrogations are undisputedly legal.

    "I have said repeatedly that America doesn't torture, and I'm going to make sure that we don't torture," Obama said Sunday on CBS' "60 Minutes." "Those are part and parcel of an effort to regain America's moral stature in the world."

    Obama's most ardent supporters are split on whether he should prosecute Bush officials.

    Asked this weekend during a Vermont Public Radio interview if Bush administration officials would face war crimes, Senate Judiciary Chairman Patrick Leahy flatly said, "In the United States, no."

    "These things are not going to happen," said Leahy, D-Vt.

    Robert Litt, a former top Clinton administration Justice Department prosecutor, said Obama should focus on moving forward with anti-torture policy instead of looking back.

    "Both for policy and political reasons, it would not be beneficial to spend a lot of time hauling people up before Congress or before grand juries and going over what went on," Litt said at a Brookings Institution discussion about Obama's legal policy. "To as great of an extent we can say, the last eight years are over, now we can move forward - that would be beneficial both to the country and the president, politically."

    But Michael Ratner, a professor at Columbia Law School and president of the Center for Constitutional Rights, said prosecuting Bush officials is necessary to set future anti-torture policy.

    "The only way to prevent this from happening again is to make sure that those who were responsible for the torture program pay the price for it," Ratner said. "I don't see how we regain our moral stature by allowing those who were intimately involved in the torture programs to simply walk off the stage and lead lives where they are not held accountable."

    In the years after the Sept. 11, 2001, terror attacks, the White House authorized U.S. interrogators to use harsh tactics on captured al-Qaida and Taliban suspects. Bush officials relied on a 2002 Justice Department legal memo to assert that its interrogations did not amount to torture - and therefore did not violate U.S. or international laws. That memo has since been rescinded.

    At least three top al-Qaida operatives - including 9/11 mastermind Khalid Sheik Mohammed - were waterboarded in 2002 and 2003 because of intelligence officials' belief that more attacks were imminent. Waterboarding creates the sensation of drowning, and has been traced back hundreds of years and is condemned by nations worldwide.

    Bush could take the issue of criminal charges off the table with one stroke of his pardons pen.

    Whether Bush will protect his top aides and interrogators with a pre-emptive pardon - before they are ever charged - has become a hot topic of discussion in legal and political circles in the administration's waning days. White House deputy press secretary Tony Fratto declined to comment on the issue.

    Under the Constitution, the president's power to issue pardons is absolute and cannot be overruled.

    Pre-emptive pardons would be highly controversial, but former White House counsel Arthur B. Culvahouse Jr. said it would protect those who were following orders or otherwise trying to protect the nation.

    "I know of no one who acted in reckless disregard of U.S. law or international law," said Culvahouse, who served under President Ronald Reagan. "It's just not good for the intelligence community and the defense community to have people in the field, under exigent circumstances, being told these are the rules, to be exposed months and years after the fact to criminal prosecution."

    The Federalist Papers discourage presidents from pardoning themselves. It took former President Gerald Ford to clear former President Richard Nixon of wrongdoing in the 1972 Watergate break-in.

How can you pardon someone

How can you pardon someone before they are prosecuted? Will the Obama Justice department deny due process to the victims of torture? Will they be refused a day in court? How does he propose to silence them?What about the International Criminal Court; will we refuse cooperation with them and officially announce to the world that America may commit war crimes at will?Rincon How do you swear an oath to uphold and enforce the Constitution if you plan to selectively refuse to prosecute lawbreakers?

The American people, who are

The American people, who are generally fast asleep, will have a huge wake-up call when Obama takes office in January and the whistle blowers come out of the closets with the shocking information about more of the crimes that the Bush/Cheney cabal committed during their reign of terror! I believe this is the wrong

I believe this is the wrong signal. The only way to move into a future filled with hope and promise is if we learn the lessons of the past and take steps to ensure that the mistakes and the abuse cannot be repeated by future administrations. If crimes have been committed, they need to be investigated and the criminals brought to justice. That is a foundation of our laws and moral code. Turning the page does not mean covering up the past with paperwork. I worked hard over the last 12 months to elect a leader who would fulfill my hopes for the future. And part of those hopes depended on holding the current administration accountable for the erosion of our foundations. Legal, Social, Financial and Physical, all aspects of our national foundation need to be secured for future generations. Please. Let Congress fulfill their duty to the American People. Let the investigations continue, and let Justice roll down the mountain like a mighty river.

Not long ago we had a personable young gentleman by the name of Ted Bundy here who thought it was fun to kill young women. Following the logic of those who say "let's just get on with it and forget the past" we should have just scolded Ted for his murders and let him go on about his life. We fried Ted to a crisp in a special chair instead. Personally, I think this was the right thing to do. Even if it had no deterrent effect, it certainly is an effective approach to recidivism. Had Nixon and his minions been punished for their crimes we might have been spared the last eight years of criminal activity by the Bush administration. Eight years that has brought our country to it's knees both locally and internationally. The proper course of action for us as a country is the same as that taken with Ted Bundy. To frog-march all the suspects, and especially George W. Bush, in chains to the Hague for trial and punishment. Any other approach tells the world that we are NOT a nation of laws, but a nation of special privilege for an elite few. Moreover, just as harboring a murderer and protecting him from local law would earn any ordinary citizen a piece of the crime as an accessory, so harboring Bush's crimes makes us all accessories to them in the eyes of the world. I do not believe that the

I do not believe that the answer lies in prosecuting the soldiers and agents who performed the interrogations. However, I *do* believe it is necessary to prosecute those who allowed this. I would include Bush, Cheney and others who adopted the policy, as well as those who crafted the BS legal arguments. They SHOULD pay for their crimes... including the crimes of sedition and treason. Read Vincent Bugliosi's book: The Prosecution of George W. Bush for Murder. According to him, every state in the union has lost a soldier in Iraq, described as murder by Bugliosi. Obama doesn't have to get his hands dirty by prosecuting Bush - any attorney general from any state can bring up a murder charge against Bush, and murder doesn't have a statute of limitations.

You guys all need to calm

You guys all need to calm down. There was never any chance of prosecutions of Bush Administration officials. In order for that to happen, they would have had to break laws so clearly that no one -- even their partisans -- could deny that the laws had been broken. The law on permissable interrogation techniques is ill-defined as it applies to enemy combatants and non-military "terrorists" or suspected terrorists. There is no applicable law and there is no consensus. As a result, there is no crime. No crime, no punishment. A more serious approach to this problem would be to extend the protections of the U.S. Constitution to foreign detainees of all types. This would require granting foreigners the same Constitutional rights as American citizens. This approach would require an act of Congress. Absent such legislation, the situation with respect to captured foreign nationals interrogated by U.S. agencies or military personnel will remain undefined.

The victims must bring the

The victims must bring the suits, here or somewhere else. The stories must be told, and compensation asked for. The taxpayers should not have to feed Bush and Cheney. Maybe the French president would allow Bush to go to France. As for Cheney, maybe he should go to Georgia, the one recently in a brief war with Russia. I hear the ranch in Texas has solar panels. We should all be able to go look at them if we want to. Obviously, these guys did not care about the reputation of the U.S. as a can-do, good-willed, open place with an operative bill of rights. We learned two years ago when Nancy Pelosi nixed Waxman's impeachment initiative that the Democratic leadership has no sense of statesmanship. Political expediency trumps Constitutional obligation. At least investigations would have exposed (one hopes) what has taken place. Is it really the case that there is no redress if Bush were to issue preemptive pardons of his own administration's criminality? The Constitution actually immunizes the executive branch---it's above the law? Mr Obama wants to surround himself with people whose perspectives are different from his own---centrists and conservatives but no real progressives anywhere...Apparently the only "change we needed" was bipartisanship--style and tone, not policy. There must be some accountability. I understand the immediate need and reasoning for recommending that we "move on" and not get side-tracked from the current mission of getting America back on an economic, moral, ethical, legal, and social track. However, after reading "The Dark Side", by Jane Mayer, it is vividly clear to me that what has transpired was intentional and premeditated. As such, we absolutely need to send a clear and resounding message that the twisted, evasive logic and misguided interpretation of American and international laws and treaties used to justify and condone torture that was advocated and endorsed by senior members of the Bush Administration is constitutionally, morally, ethically, and legally unacceptable and reprehensible. At minimum, the core members of the Vice Presidential advisory team most intimately involved in and responsible for establishing the justification that endorsed these crimes against humanity and the American Constitution should be censured and barred from any and all future dealings (either directly or indirectly) with any and all US Federal Government entities of the Executive, Administrative, and Judicial branches; this would extend to being forbidden from engaging in any lobbying activities on behalf of any 3rd parties, or being barred from involvement in any programs or organizations that receive federal funding of any kind. Additionally, we should also clearly indicate that we will not impede any international efforts to bring the most culpable individuals to justice (i.e. The Hauge).

I am surprised at the how

I am surprised at the how naive some of you are! As a Canadian who has worked in the anti-poverty movement here I know that even small-time "important" people never suffer the consequences of their wrong-doing because most of the public sucks up to power in any form. In the 90's we had a so-called social democratic government here in my province, British Columbia. They sold out to the right, copy-catting your Clinton administration, especially in the matter of screwing the poor! Of course Obama will sell out. He's a politician. What did you expect? if these issues(crimes) are not addressed in a REAL and transparent way, any 'moving on' will be absolutely fictitious. not only that but 'national security' in a very real way will suffer because sweeping the last 8 yrs under the rug will justify for many here and abroad their own view, i.e. cynicism, disappointment, disbelief and anger at what America has become. not only that but among the more extreme elements in the world, this will absolutely be the motivation for continued attacks against all things deemed American and/or even democratic. besides these very pragmatic reasons for truly cleaning up the mess we've created and holding those responsible for their actions is the (dare i say) 'spiritual' side of the equation; what goes around comes around and make no mistake, without this 'putting our house in order' the future very likely will hold even worse scenerios we will all come to suffer and regret, just as past negligence and under-the-rug sweeping has led to these shameful events we've just witnessed. and while some are many times more guilty than others, as a supposed 'government by the people for the people' WE have all condoned/allowed this and so partake of the guilt. so... this is how the The Land Of The Free and The Home of The Brave rolls? i find it incredibly dispiriting and shameful, the legacy these times will leave for those who will struggle to know the truth and act from it towards a better world; our lack of action now contributes to the ignorance and suffering of future generations.

First of all-- the term "mandate", a staple of pop poli-sci beloved by the public and media infotainwhores alike, is a nonsense word. My driving instructor, a firm believer in defensive driving, used to always warn me that even if one has the right of way, one can't "take" the right of way. Whether politician or pundit, claiming a mandate is like "taking" the right of way. At best it's a Rorschach inkblot test, where each viewer shapes ambiguous patterns according to the viewer's individual perceptions-- there's no objective "there" there. So if Obama intends to give the present criminal maladministration a pass, and sends them all to "Go" to collect two hundred million dollars, he'll simply deny that there's any sort of "mandate" to do otherwise. Furthermore, as I've been screeching for months on various comments forums, the tragic truth is that over the past few decades, our federal political institutions have transmogrified right before our unseeing eyes into para-corporate service delivery systems occupied by a typically wealthy cadre of technocrats. That is, our politicians are not "moral" in any retail human sense; every senator and congressman (and executive officer) is a wholly-owned franchise or subsidiary of government. It's all about the benjamins, one way or the other-- from the wheeling and dealing to control and allocate public funds to the perpetual campaign fundraising to keep the franchise going. Oh, ethics and morality are more popular than ever in political oratory-- it's no accident that skilled communicators are worshipped by a credulous public. We're a lip-service lovin' nation! But, exactly as former Attorney General Gonzales implied that the Geneva Conventions were "quaint" and effectively obsolete, so do our veteran and newly-elected politicians treat Constitutional duties and the rule of law as "quaint". I hate to harsh everyone's buzz over the recent Historic Election, but I wouldn't set too much store in the pious, moral, and squeaky-clean demeanor of the Technocrat-Elect. Handsome is as handsome does, I say. Just stop listening to the patter and watch his hands instead. For months now, devoted supporters have been stating with varying degrees of condescension and reassurance that Obama is way ahead of all of us. Whether it's voting for FISA or sticking with neo-lib, Democratic neo-con staffers, True Believers claim this is part of Obama's Secret Plan to return the nation to humane policies and practices and the rule of law. Gee, I'll really feel stupid for misunderestimating him-- I'm looking forward to it.

This is "white collar" crime of the highest sort and, like typical "white collar" crimes, they'll be lucky to get a slap on the wrist while the petty thief gets the book thrown at him. If this crew is not properly accused in a court of law, they will not be properly tried, convicted, and hung in the court of public opinion. Obama--if you do not allow your justice department to pursue and prosecute at least the crime of torture, I rescind my vote in support of you. US Army Major General Taguba reminds us that the victims of torture do not recover, but actually carry the scars of such treatment invisibly for the rest of their lives. Citizens must realize that the very existence of torture implies the breakdown of Law, Due Process, and accountability from those in power. Once incriminated in crimes of torture its proponents and apologists must work to erode the democratic laws in place that would hold them accountable.
