Missing Votes Spark Lawsuit

Brunner: Touch-screen machines defective, company should pay.

    The touch-screen voting setup used in half of Ohio's 88 counties doesn't work properly, and the former Diebold Election Systems should pay as a result, Secretary of State Jennifer Brunner said in a court filing yesterday.

    The move comes fewer than 90 days before Ohio voters go to the polls in an election that could decide the presidential race, but Brunner says safeguards will be in place by then in the affected counties to mitigate any risks.

    "We will make the equipment work, but this is not something that Ohio should be satisfied with for the long term," Brunner said. "Our goal is to have Ohio taxpayers compensated for this equipment that doesn't function properly."

    Brunner is seeking punitive damages from Diebold, now Premier Election Solutions, after she said an investigation showed that votes in at least 11 counties were "dropped" in recent elections when memory cards were uploaded to computer servers.

    Elections workers discovered the missing votes, but not until many hours later in most cases, Brunner said. The malfunction first was discovered in Butler County in April, she said.

    Forty-four counties, including Licking and Fairfield in central Ohio, use Premier touch-screens. Franklin County uses touch-screens from a different manufacturer.

    Premier filed a lawsuit against the state and Cuyahoga County in May seeking a ruling that it had satisfied the obligations of its state contract to provide touch-screen voting machines in the county, which replaced the equipment this year.

    County officials responded by accusing the company of breach of contract, fraud and negligence, and Brunner filed a counterclaim against the company yesterday in Franklin County Common Pleas Court.

    Brunner wants the court to find that Premier made false representations about its equipment and failed to live up to contractual obligations and warranties. Ohio spent millions of dollars in mostly federal funds to upgrade voting systems after problems with punch-card ballots in Florida in the 2000 presidential election.

    Premier spokesman Chris Riggall said he hadn't seen the court filing and couldn't comment on it specifically.

    But he said a conflict was identified involving the company's software and virus-protection software. A product advisory was issued in May, but Brunner said her office still is reviewing that explanation.

    Riggall defended the systems, which he said are used nationwide and have features in Ohio, including a paper audit trail, to ensure votes are counted.

    "We have, in fact, provided a quality voting system," he said. Last year, North Canton-based Diebold Inc. sought to make its Allen, Texas-based elections division more independent and changed its name.

    Brunner, a first-term Democrat, commissioned a study last fall that concluded all touch-screen voting systems used in Ohio are substandard and should be replaced with a paper-ballot system.

    But the Republican-controlled legislature and many elections officials objected, saying no election system is perfect and that security procedures should be beefed up instead. That is happening this fall.

    Steve Harsman, director of the Montgomery County Board of Elections, said there were three instances since 2005 when memory cards in his county did not upload votes. The problem was caught but chalked up to human error at the time, he said.

    Harsman, a former president of the Ohio Association of Election Officials, said he's confident that the problem has been identified and that procedures will be in place this fall to avoid any problems.

Why is this just now making news? Didn't anyone in Ohio see "Hacking Democracy"? Or what about the article in "Rolling Stone", in 2006, about Dieblold?

Computer voting should be

Computer voting should be banned. This is technology applied to solve a problem that didn't exist. Shame on everybody. By far the most effective and enjoyable way to vote is by mailed ballot. Besides, on voting day maybe a hundred million or so gallons of gas wouldn't be consumed going to the polls.

They should do what Canada

They should do what Canada does. Mark your x on the paper ballot, then it is counted by an optical scanner. No expensive computers, instant results, and it is easy to recount the original ballots if needed.

In Arlington VA we have

In Arlington VA we have used touch screen voting for many years. My son, has worked on Department of Defense classified systems and currently works in civilian IT. He states that all one needs to do (best late in the day) is to walk by the voting machine booths in late afternoon with a large magnet in ones purse or pocket, thereby erasing all the previously recorded votes. Why don't we have a paper receipt printed following every ballot, and the voter check it for accuracy then place in the old locked ballot box? If there are problems, the paper ballot receipts provide the actual vote.

To the contrary, I think that the Diebold machines are working just as designed or programmed to do what they are supposed to do. Yes, the problem with the

Yes, the problem with the counting of the votes and who actually counts them could very well lead to a victory for McCain in November. Americans throughout the country are being denied their Constitutional rights to vote and to have their votes counted fairly. Since the Supreme Court decision during the 2000 presidential election, the votes of the people have been counted by the few who have been utilizing computer programmed memory cards to count the votes in many states. Such devices can be used to yield totals completely inconsistent with the actual results. To that end, I am quite certain that the Congress of the United States is full of Senators and Congressmen who should not be there simply because their opponents won the actual vote count. Do we really expect these people to introduce legislation that will truly protect the people's right to vote and to have their votes counted? As such, do we really expect them to champion the Constitution given the fact that adherence to the dictates of such a document would probably give an electoral advantage to their opponents? Soon, if the people do not wake up, most Congressmen will have obtained their seats by virtue of games played with these machines, not through the votes of the people. This set of circumstances would then be quite dangerous simply because congressmen and presidents would likely begin to believe that they owe greater allegiance to those who control the voting machines rather than to the people whose votes seem to disappear in a black hole. In fact, I am sure that many so-called elected officials already believe this, and that's why they tend to vote against the interests of the people on most important issues put before congress. FISA, the Military Commissions Act, and the Patriot Act are just a few examples. We are therefore steadily moving backward in time when in the 1600's only those who owned land had the right to vote and have their votes counted. The main difference between then and now is that today voters may show up at the polls to vote, and this engenders the perception that the average person in America has the right to vote and the erroneous view that the Constitution is being rigorously adhered to. What is being carefully and steadfastly obscured however is that only those who count the votes decide who wins.

The problem with these

The problem with these machines is that there is NO WAY TO RECOUNT THE VOTE. The only thing you can do is take the precinct totals and add them up again. (In Ohio in 2004 they took the additional precaution against a John Kerry win to run the totals through a server that also had GOP software.) With no recount, these machines can be manipulated any way the vendors want -- and the vendors are all GOP. Get rid of these machines. Return to a paper ballot before the citizens of this country have lost our democracy forever. There will never be a trustworthy result from these machines.

It is inconceivable that

It is inconceivable that Diebold can make hacker-proof ATM machines yet FAILS UTTERLY to provide a secure, reliable, RECOUNTABLE vote! Never have understood that. Of course, the company IS owned by a Republican who promised to 'deliver Ohio' to TGDSOBGWD. He did it too, in 2004, will he get away with it again? Come on people, this isn't rocket science, can't they really solve this problem? I think this falls under 'high crimes and misdemeanors' and is fully prosecutable under existing law. It is all of a piece with the overall strategy of Deliberate Stupidity embraced by the Head Imbecile himself, Dumbya. And it's about time this policy was laid to rest! If the Repubs wish to establish themselves as totally owning the lowest common denominator it is up to the rest of us to raise the debate and address the Constitutional crimes of the Dumbya-enabling administration.

First commentor: this is not

First commentor: this is not just now making news. Jennifer Brunner (new Sec of State of Ohio) has been in the news ever since she was elected. Ohio was 2004's Florida, i.e. the biggest example of the year of GOP cheating. More than one Ohio county counted more republican votes than there were actual population of the county. This is one of the reasons Brunner won the election, the previous Sec of State was a complete fraud. I think I've read a story about this patriot at least once every couple of months for a couple of years now. Google her and you should see several stories on this topic.
