The Systematic Destruction of Voting Rights in America (Part 1)

    You might think you have the right to vote. You might think your vote counts. You might think that there's a problem here or there, but that they're the exceptions. You might think that the 2000 presidential election was an aberration, in which the U.S. Supreme Court violated ethical and court precedents to crown the election loser, countering the will of the people. You might think it can't possibly be an ongoing problem.

    You might be very sadly mistaken.

    Voting rights are under systematic attack in the United States. Techniques include:

  • Outright disenfranchisement.

        

  • Vote switching in election machines.

        

  • Refusal to allow the public to see how votes are counted.

        

  • Use of the people's courts by political parties and corporations to subvert the law.

        

  • Use of lawsuit threats by large corporations against cash-strapped local governments to prevent them from examining voting machines.
  •     Each one might not seem like a major issue, but taken together, it's clear that there's a coordinated attack on American citizens' rights to vote.

        Vote Flipping

        Brad Friedman has been following the problem for years, but even he was stunned when it happened to him when he voted in Los Angeles during the June 3rd California election:

        "Right before my very eyes, the computer-printed ballot produced by the voting system I was using, incorrectly filled in bubbles for four of the races I was voting in. Had I not been incredibly careful, after the ballot was printed out, to painstakingly compare what was printed to what I actually voted for, I'd have never known my votes were being given to candidates I did not vote for."

        As Friedman went on to point out, if he'd been blind, there would have been no way to know that his votes were changed. Forty percent of his votes were flipped. Because of his prominence, the machine he'd voted on was quarantined. No one bothered to check out the rest of the machines at that polling place or others of the same type.

        Voter Caging

        Legitimate voters who are likely to vote for the "wrong" candidates are identified and systematically excluded from the voter rolls. Different techniques are used, but one documented by reporter Greg Palast tells of one method.

        Before the 2004 election, military personnel who came from predominantly black neighborhoods were targeted. The Republican National Committee sent them letters addressed "Do Not Forward". Most, if not all, of the addressees were serving their country in foreign lands. Lists were drawn up of the names on the letters that had been returned as undeliverable. The lists were sent to the RNC. These soldiers had been "caged".

        Their voting registrations were challenged, based on the returned mail. Once their names had been removed from the voting rolls - without any attempts to locate and inform them - they lost the right to vote in the next election, whether they had returned home and gone to the polls or they had sent absentee ballots.

        Through voter caging and other techniques, over half a million voters were disenfranchised during the 2004 election. The vast majority of those who were disenfranchised by caging were black military personnel.

        Lack of Transparency in Vote Counting

        In the recent June 3rd election in Monterey, California, two election observers were harassed and prevented from observing the process and the equipment used for tabulating votes. From the first, when they formally requested access, citing the California code that specifies the rules for observation - which quite clearly gives the right to check out all phases of the election, along with all computer and tabulating equipment - they were stonewalled.

        In spite of the attempts to stop them, Valerie Lane and Brian Rothenberger were able to see obviously illegal activities and clear indications that it would be easy to tamper with the vote count. They were stalled, ordered to leave, and threatened with arrest.

        The second article in this series will discuss the specifics of how Mr. Rothenberger and Ms. Lane were prevented from doing precisely what the law - and democracy - requires.

        Lawsuit Threat

        In New Jersey's Union County, paper records of the number of voters in the recent primary election did not match the results produced by Sequoia Voting Systems' machine printouts. Naturally, the County Clerk, Joanne Rajoppi, wanted the problem investigated. The Constitutional Officers Association of New Jersey, an organization of state sheriffs, county clerks, and other similar officials, concurred, calling for an independent review. They planned to have it done by a Princeton University computer scientist who has experience with voting machines.

        It isn't going to happen. Sequoia claims, without any proof, that the errors were the result of errors by poll workers - an interesting concept, considering it's never happened before. Using double-speak without a hint of embarrassment, they say that they "welcome all such responsibly executed review activities." How that can be done, though, they don't say - but they aren't going to let Union County do an investigation.

        Sequoia threatened a lawsuit against Union County, claiming that an independent investigation would violate their licensing agreement. The county has no option but to capitulate. The cost of defending such a lawsuit is prohibitive for them.

        Left in the balance are the voters who have been disenfranchised.

        A Chilling Subversion of Our Democracy

        The implications for American democracy are chilling. A concerted and systematic effort has been underway to prevent the will of the people from being heard. The very basis of the governance of our nation is at extreme risk.

        Thomas Jefferson wrote: "Should things go wrong at any time, the people will set them to rights by the peaceable exercise of their elective rights." He had faith in the people's ability to make good decisions through voting. What would he think now, when that most basic of freedoms - the one at the heart of our society - is becoming a ghost, nothing more than the image of what it was meant to be?

        Alexander Hamilton said that a republic's right to vote "ought to stand foremost in the estimation of the law." Now, the right to vote is becoming little more than a shadow cast behind the actions of those who cast their votes into a void. Increasingly, it exists more in form than in substance.

        Different techniques that have been used - and continue to be used - will be discussed in depth in upcoming articles. The only way to stop the theft of democracy is through awareness of what's happening. If you know that you're a potential target of vote theft, then you can protect both yourself and the future of the nation.

    The entrenched criminal

    The entrenched criminal regime will do ANYTHING to prevent a free and fair election, and to subvert justice and the law. You can bet your bottom dollar on this absolute FACT. Come to think of it, you probably already have.

    Why is this acceptable? We

    Why is this acceptable? We should be: using open source software, mandatory selective sampling, machine manufacturers should openly transparent, and election boards non-partisan. This shouldn't be so hard in a "democracy".

    I believe this corrupt

    I believe this corrupt Administration and Republicans (not all of them) will do ANYTHING to maintain power over this country (and the world). IT'S IMPERATIVE THAT EVERYONE BE VIGILANT AND DO WHATEVER NEEDS DOING TO PREVENT THE REPUBLICANS FROM STEALING THIS ELECTION. THE FUTURE OF THE WORLD IS AT STAKE.

    I've been coming to the

    I've been coming to the reluctant conclusion lately that our "democracy" is a sham and that only the policies and candidates endorsed by the collective corporate oligarchy will be enacted or elected regardless of public outcry or disillusionment. There is simply too much wealth at stake for those with disposable wealth not to invest it in politicians that will enhance their advantages. The Bush Administration and the Congress over the past few years have shown how deeply corrupt our government is. Candidates spew sound bites like bait and once voters are hooked into voting for them, they proceed to betray the common good for the special interests. As in the Roman Empire, the government becomes a tool fo the business community, rather than a guardian of justice.

    I implore everyone to write

    I implore everyone to write to their Senators and representatives (both Federal and State) and demand to know what they are doing about this. Just copy the above article and tell them we won't sit by and watch our country become a banana republic. Then write to the corporate media and ask why this isn't being covered on a nightly basis. All it will take is for Republicans to tinker with a few swing states and we will have President McCain.

    A criminal gang has taken

    A criminal gang has taken over our country, cloaking their true values and criminal mindset with religious and patriotic manipulations. Their authority has been derived through a systematic and fraudulent manipulation of the electoral franchise. It is especially galling that the incident involving Brad Friedman in the June election occurred in California. It is made worse when such an incident did not trigger an immediate investigation by the two Constitutional officers charged with the duty of insuring that all voting systems being used meet the requirements of law, and any possibility of widespread voting system perpetuated fraud be immediately investigated. Specifically, Secretary Bowen ran on a platform of ridding the state of the repeatedly proven insecure, unreliable, and easily hacked electronic voting systems. Her own state commissioned computer teams confirmed the danger these voting systems were to our electoral franchise. Yet she failed to withdraw approval, instead applying a band-aid approach of procedural mitigations which are not even followed. She is specifically empowered by California law to seek the services of Attorney General Jerry Brown to enforce the election laws of this state. Even without that request, AG Brown has the power and duty to initiate investigations, seize equipment that may be involved in thwarting the will of the voters, and seeking criminal indictments or civil damages for those involved in denying our right to choose who shall represent us. The citizens of this state and country have been effectively neutered from exercising the only peaceful power we the citizens have when politicians, corporations, or government officials abuse their public trust. Those who occupy public office make life and death decisions that impact millions of citizens. It is time citizens demanded accountability by those charged with running our elections. Currently they are complicit in this betrayal of America. My thanks to Heidi Stevenson for raising this issue, and for the hundreds of citizens who have been fighting to restore our franchise, and organizations like Black Box Voting, Voters Unite, Verified Voting, and Voter action.     Nothing in this article

    Nothing in this article should come as a surprise to anyone. What we are seeing here equates to what recently happened in Zimbabwe, although perhaps a bit slicker and a bit less heavy handed. But the result is the same. We need to send out a call for international observers for our elections. Or better yet, make any corruption and subversion of our voting rights a capital crime. In the meantime, we need to establish a truly independent election management organization, ensure that we have verifiable, re-countable election records, and eliminate archaic institutions like the Electoral College. At the end of the day, we need to determine who can protect our constitutional rights and ensure their empowerment (along with checks and balances) so that the corruption of our democratic principles is reversed.

    Unfortunately, articles like this serve little purpose other than to get the already mad madder. Anecdotal reports and/or citing blogs is not going to convince a neutral person that action needs to be taken. To gather voter momentum to support measures to replace voting machines, or to pass laws against systematic roll purges, only solid, well-investigated, publicized cases will do. If there's a problem w/the mainstream press and getting this information out, then work needs to start there.

    I, for the most part, agree

    I, for the most part, agree with all comments that have been made thus far. Nonetheless, we have to admit that the corporations and their government lackeys have spent the last 100 years dividing Americans by race, sex, party, religion, etc. These divisions must be addressed and broken before Americans can develop sufficient unity (power) to overcome the existential fascism constructed from a strong relationship between corporations and government. Addressing matters of division, which the people themselves have long neglected, takes much time and contemplation. Therefore, I predict, despite the obvious gross failure of the Republican party since Nixon, that McCain will defeat Obama if the people themselves fail to sufficiently address their idiosyncracies, marked mostly by division, before the election in November. This should be a critical time of self-examination; we must begin to stare down the sexism and racism that may well exist within our unconscious selves. In sum, McCain has a chance to win because of who we are or, more precisely, how our psyches have been systematically fashioned over the last century or so.

    What we can we do prevent

    What we can we do prevent this (and all of the other aforementioned voting disasters) from happening on November 4, 2008? I'm a resident of Butler Co., OH and my husband & I went to the polls early to vote in the 2008 primary. I touched Barack Obama's name, but the computer screen read it as Hillary Clinton. Knowing how these touch screens often misread the touch, I watched carefully for just this sort of thing. I corrected it. I wonder how many others didn't notice it? While I attribute the above to be more of a faulty system, not fraud, Butler Co., OH is a strange place full of underhanded Republican officials. There are people in this county afraid to say that they are Democrats for fear of losing their jobs. This fear is not always administered by bosses of political jobs either. The racists remarks I have heard, the fact the McCain/Obama polls are close, and the importance of Ohio on November 4th are all enough reason for someone to try to "fix things." This is a Republican county with very few Democrats in power. If any year would produce shenanigans, 2008 would. I would appreciate hearing from anyone with good advice on voter fraud prevention in Butler Co., Ohio.

    We must all keep loudly

    We must all keep loudly demanding verifiable voter paper trails. I have already written to every elected representative I have, now I will start writing to the media.

    Perhaps any voter who

    Perhaps any voter who encounters a voting machine that switches a vote or misprints a paper ballot output should, first, SMASH THE MACHINE and completely disable it. Then ask to use another working machine. If the same problem occurs again, well, repeat as needed... Interfering with or changing someone's vote is a felony, and the victim should be entitled to stop that crime as it is happening.

    I think that when Sequoia threatened a lawsuit, they should have simply yanked the machines. If Sequoia is so big and strong it can just get by without future contracts. If they refuse to allow their machines to be investigated, it must be assumed they are hiding something. Proprietary code, my foot. Nobody is going to steal your code on how to steal an election. They just want to read it and send you to prison, Sequoia.
