This Is Not the Change We Hoped For: House Concurrent Resolution 362

    Though America voted for change in 2006, the subsequent two years have demonstrated that the Democrats in Congress, while avowing a "new direction for America," are as willing and as skilled as their Republican/neocon counterparts at utilizing half-truths, innuendo, deceit and scare tactics to mislead the American public along the path to another devastating and unnecessary war. Consider, as a case in point, H. Con. Res. 362, introduced by Representative Gary Ackerman (D-New York) and co-sponsored by 261 members of Congress (at this writing), many of them Democrats. This bipartisan resolution is flawed - perhaps even suspect - for a number of reasons.

    First, it asserts as fact that Iran is pursuing nuclear weapons and intimates that it would share its nuclear material and technology with terrorists and "rogue" states. The reality is that as of the end of July 2008, the International Atomic Energy Agency (IAEA) had conducted over 3,000 man-days of scrupulous inspections, including nine visits that were unannounced.

    In a report to the IAEA Board of Governors dated May 26, 2008, Dr. Mohamed ElBaradei affirms, "The Agency has been able to continue to verify the non-diversion of declared nuclear materials in Iran. Iran has provided the Agency with access to declared nuclear material and has provided the required nuclear material accountancy reports in connection with declared nuclear material and activities." The National Intelligence Estimate (NIE) corroborates the IAEA's findings. "We judge with high confidence that in fall 2003, Tehran halted its nuclear weapons program.... We assess with moderate confidence Tehran has not restarted its nuclear weapons program as of mid-2007" (November 2007).

    Credible evidence exists, therefore, to refute H. Con. Res. 362's claim that Iran is pursuing nuclear weapons and engaged in "illicit nuclear activities," the primary premise upon which this resolution builds its argument for sanctions and a blockade. The fact that this evidence is readily available to members of Congress raises concerns regarding their intent and motivation in sponsoring a resolution that exaggerates, if not fabricates, a "threat" posed by Iran to stability in the Middle East, the survival of Israel and the vital security interests of the United States.

    Second, the argument as presented in the resolution is of questionable construction. Initially, it speaks of "preventing Iran from acquiring a nuclear weapons capability" - a concern, perhaps, if true, which many Americans can at least sympathize with and understand. It then, however, resolves to accomplish this end - to deal with this threat - by compelling Iran to "verifiably suspend its nuclear enrichment activities." That is, it ignores and/or conflates the critical legal distinction between enriching uranium for weapons production and enriching uranium for peaceful purposes which is Iran's sovereign right under Article IV of the Nuclear Nonproliferation Treaty of which it is signatory. Now, this is not just careless language, but is integral to the basic purpose of this resolution. By conflating the two uses of uranium enrichment, the resolution misleads the American public into believing that since Iran has admitted to enriching uranium for peaceful purposes, despite evidence to the contrary it must also be guilty of enriching uranium for weapons production.

    Third, H. Con. Res. 362 demands that the president immediately impose "stringent inspection requirements on all persons, vehicles, ships, planes, trains, and cargo entering or departing Iran." Such a land, sea and air blockade, with no mention of seeking a Security Council Resolution, is more than mere provocation; it constitutes an act of war. In fact, the International Criminal Court will include blockade in its list of acts of war in 2009. It doesn't require a degree from the War College to understand that the effectiveness of a blockade hinges upon a credible threat of military action.

    A resolution that demands a blockade, therefore, is also authorizing inter alia the use of military force should, for example, ships bound for or leaving Iran refuse to be boarded and stringently inspected. But yet, when confronted with the concern of many of their constituents that the resolution is not an alternative but a prelude to war, sponsors are quick to note that H. Con. Res. 362 includes the disclaimer that "nothing in this resolution shall be construed as an authorization of the use of force against Iran."

    Clearly, this proviso indicates that the sponsors of this resolution are either unfamiliar with the nature of blockade or have learned a lesson from their ill-fated support for the Iraq resolution. If the former, then they are negligent in their responsibility to familiarize themselves with how blockades function before sponsoring a resolution that could quite easily lead to violent confrontation and war. If the latter, then sadly, the lesson they learned from the Iraq debacle was not that they should avoid supporting resolutions based upon lies and deceptions, but, rather, that they should prepare beforehand the means for escaping responsibility and culpability for involving our nation in a another tragic and devastating conflict.

    If we are to believe that the Democratic Party and its candidate truly offer hope, change and an alternative to the politics of fear, lies and deception, then members of Congress must, for one thing, follow the lead of Tom Allen, Danny Davis, Steve Cohen, William Clay, Barney Frank and Robert Wexler and withdraw their sponsorship and support for H. Con. Res. 362.

    If the Democrats truly wish to distinguish themselves from the Republicans and offer a "new direction for America," as Representative Ackerman claims on his web site, they must draft a new resolution - one that demands not threats of violence but diplomacy, not blockade but face-to-face negotiations with no preconditions, not sanctions but the exchange of ambassadors, not embargo but the opening of embassies, not covert operations intended at inciting unrest, ethnic conflict and regime change, but a nonaggression pact - all with the condition, of course, that both nations abide by the terms of the Nuclear Nonproliferation Treaty (NPT). That is, in return for an Iranian guarantee that its nuclear program is intended only for peaceful purposes and its cooperation in ensuring scrupulous inspections, the United States must end its bellicose posturing, sanctions and embargo, and abide by Articles I, II and VI of the NPT and reduce its nuclear arsenal, cease its development of a new generation of tactical nuclear weapons, and end its deployment of nuclear weapons around the world. This is the change we hope for; this is the new direction for America we must demand.

I honestly think that

I honestly think that bringing religion into this discussion simply muddies the waters. This is about wealth and power, and cuts across ALL religions, whether in central Asia, or right here in America. The Priests of War don't actually want a REAL regime change in Iran, they want a puppet that will beggar his population in order to make them wealthy (sound familiar?). Look to history. The CIA helped drive out a nascent nationalist movement there in 1953, in order to keep our puppet Shah, a boot-stomping fascist if ever there was one. After the way his Mossad- and CIA-trained SAVAK secret police terrorized his own population, a revolution was inevitable. -And we act like it's a mystery that they don't trust Israel or the US! We act like it's due to "anti-democracy", or "anti-semitism", or some other such clap-trap! -It's due to knowledge of their own history! (Not that we ever let a silly thing like historical knowledge worry our pretty heads!) Now that Iran's mostly young population has begun to question the need for a theocratic state, now that enlightened government threatens to break out again in Iran, the War Pigs want to do it all over again. Several posters assume that this proposed legislation is because of AIPAC and Israel and once again the Jews. Hey they may be right. But thank heavens Barney Frank and Robert Wexler are against 362. Oops they are Jews. And so is J Street, the non-AIPAC, which is fighting hard to defeat 362. More Jews! Me too, I'm a Jew! And I am tired of AIPAC but more than AIPAC I am tired of people blaming everything in the world on AIPAC like some great Jewish conspiracy. In 2003 I went on a couple of dates with a guy who identifies himself as Persian as opposed to Iranian. He was a child when his family emigrated to the US. He was thrilled that the US invaded Iraq. Why? Because, he told me, Iran would be next. Did you assume immediately that he was a Jew? Nope he wasn't. I by the way told him I couldn't go out with someone who approved of the war. I hope my progressive credentials are safe in spite of my religious background. Look, I met someone once who worked for AIPAC at a bat mitzvah. Sorry about that.

No. Can criticism of a candidate or political figure spread to tens of millions through the corporate owned mainstream media and the think-tank talking heads destroy a political figure? You bet. So who are these candidates and political figures going to try to make happy (or at least try to avoid upsetting)? You got it. It is not you and me. It is the ruling class.

Bica composes a great article, which exposes many members of the House of Representations as agents of an agenda that's anathema to the best interests of the United States. This is a government that is clearly harmful to its people and therefore represents not them, but a threat to them. The nightmare they are in the process of producing through HCR 362 indicates they are intent on pleasing their masters (our rulers) who have been ingesting the blood of war for many centuries. Human beings tend to pay much greater attention to those who feed them or, in this case, to those who possess the means or power to bribe or blackmail them. Congressmen and Congresswomen subject to blackmail cannot effectively serve their constituents, and those selling their votes for a bribe should be incarcerated in a society that respects, and lives by, its laws. That's why I consider HCR 362 to be a lawless resolution being produced by criminals whose votes are somehow bought by thoroughly compromised elected officials.

War = Profits. Saber-rattling against Iran, as well as all the other wars, are not what they seem to be. It's pretty well explained in the movie at www.zeitgeistmovie.com. War is the world's biggest business, with benefits to international financiers and the military-industrials. Congress, the president and the corporations are all in bed with the worldwide war/arms/debt financing industries. These conflicts are set-ups, as in professional wrestling. There truly is an evil force at work in the world, and the people who promote war and profit from it are the agents of evil.

Historically Iran and the

Historically Iran and the Jews (long before Israel existed as a country) have had good relations (as far back as history goes), and as I understand it there are Jewish communities in Iran that exist relatively unmolested including being allowed to worship as they wish. Iran is not a threat to Judaism, it is a threat however to Israeli and US hegemony and corporate interests in the middle east, and that and only that is the reason for the aggression against Iran. AIPAC does not represent the interests of Israel. It represents the interests of the rich and 'powerful' in Israel, just like Congress does, and both are the enemies of freedom, justice, and peace on our planet. Meanwhile, back when our puppet the Shah was in power in Iran a fella by the name of Richard Cheney worked to get nuclear power for Iran because the world wants Iran's oil and Iran would have more to sell if it didn't have to use it for electricity in the country. Iran's needs have not changed, but like any country in the middle east (in the entire world in fact) in these times if the leader is not our puppet then the country is part of an 'axis of evil'. America's government is not interested in negotiating because negotiating is a process of 'give and take' and the interests of those that run our government do not include 'give' in any part of their vocabulary. Any negotiations with any country that is not 'on our side' will be exactly like the negotiations our government had with the native Americans... either they give us what we want or we will kill them all. This is truly a country to be proud of.

Republican and Democrat are

Republican and Democrat are labels used by two different groups as official designations, and they don't really tell us much about the motives or values of any given individual using each of the designations. Two labels that are far more interesting and revealing are neo-conservative and neo-liberal. What is revealing is that they are two sides of the exact same coin, and if we can identify who all the "neo" people are, they we will have identified our worthy opponents. If you are surprised to find Democrats supporting the neo-conservative agenda, then you have yet to realize, or admit, that the Democratic Party is eat up with neo-liberals who have the exact same agenda as the neo-conservatives. They just don't want to be as up front as the neo-cons about it. They might think they should feed us a bit better, but essentially they want the same thing as the neo-cons. Bill Clinton is a neo-liberal and that is why we don't trust him. The Democrats and Republicans will not be trustworthy until they purge their ranks of the neo crooks that currently have way too much influence in both parties. If you want to know who the neos are in Congress, just look at who is in favor of this bill, or of picking fights with other countries in general. We hear a lot of whining about the neo-conservatives on TO, but nothing about neo-liberals. They are just as dangerous, and maybe more so, because they have the same agenda but posture as friends of the people. It's a one party system until we establish enforceable protocols for electoral integrity and audit-ability. Perhaps we could identify people in all parties who do not support the neo agenda and vote them into office? Peaceful change is within our grasp if we cherish and use the tools our elders left us. Telling the truth is a powerful medicine that is sweeping the blessed Earth right now, so perhaps it is time we 'fess up to the mote in our own eye.

Unfortunately, anything that looks to be remotely in support of dealing fairly with Iran is taken as not being in support of Israel. And even though giving Israel unconditional support will eventually be one of the major downfalls of this nation, don't look to any major politician to side against Israel if said politician wants to have a career that lasts more than one election cycle. I, personally, think we should sever our Israeli link, but I don't typically hold the same views as the average US citizen. And I would love dearly for our nation to abide by the terms of the NPT, so we could practice what we preach on at least one front. But as long as someone is able to strike fear into the hearts and minds of mom and pop, grandma and grandpa, or until someone with serious ill-will manages to get their hands on one of our stockpiled weapons, we will never stop our own nuclear proliferation. It would take someone with serious guts, determination, and massive vocal and monetary backing by the general US population en force for that to ever happen. But I still have hope. For without hope, what else is there?

How can we expect congress to give us honest laws when they are all receiving millions from lobbyists representing industry? Industry's goal is more profits and the best and most profits come from war. Not many citizens can give the amount of money that lawmakers receive year in and year out from paid lobbyists.

thank you...this article lays it out in a simple, clear, direct way, with a true observation and assessment of the realities we are seeing (and not seeing). we MUST become more aware as human beings, citizens of america AND the world towards clearing out, seeing through, correcting and refusing to accept the bullsh*t that is continually foisted on us all by those with cynical, nefarious power play agendas, narrow ideological 'answers' and violent fear based reactionary ploys that creep the world towards apocalyptic ends and keep us all suffering needlessly so they can 'profit' from the death and destruction. i'd say TRUE EDUCATION would be a great place to start.

Why doesn't the US pass a law to help the Iranians have a peaceful non-violent regime change. It needs to emphasize the creation of a nationalistic opposition council that is above both politics, religions, and commerce. This body needs to have only the cultural heritage of Iran at its best interest. To that goal, the aim should be to convince the people of Iran of the peaceful nature of the regime by means of a General Strike. The people of Iran will then know that they are much stronger if they oppose the theocracy along a peaceful national unity. The new body of nationalists will then represent Iran properly and replace the theocrats.

I do not know the history of the in's and out's of U.S. Congressional resolutions, but this one, 362, is clearly some kind of ploy, and it could be broadly reflective of some non-partisan strategy against Iran. However, it is most likely a political 'play' to, for some reason, produce the appearance of a bluff: the "resolved...(3) demands that the President initiate an international effort to immediately and dramatically increase the economic, political, and diplomatic pressure on Iran to verifiably suspend its nuclear enrichment activities by, inter alia, prohibiting the export to Iran of all refined petroleum products; imposing stringent inspection requirements on all persons, vehicles, ships, planes, trains, and cargo entering or departing Iran; and prohibiting the international movement of all Iranian officials not involved in negotiating the suspension of Iran’s nuclear program;" is preceded by the preamble: "Whereas nothing in this resolution shall be construed as an authorization of the use of force against Iran..." Clearly "(3)" would be an act of war. So, the inherent contradiction: this is probably the kind of thing that they having been tittering about in diplomatic circles around the world since it was made public (May 22, 2008.) It's bi-partisan nature (whatever the count) shows 'House'-wide desire to look tough on Iran. It's a presidential election year. Everyone's jostling to look tough (and other stuff.) Out of view of the public, they (the 'House') were probably laughing about it themselves. To the U.S. public, it looks like what it looks like: we are tough on terrorists, support Israel, won't take no guff from Iran, by cracky (do they still talk like that anywhere?) Hey, this is what we pay our Congressional reps. to do. (What?)
