Van Hollen's Lawsuit Will Muck Up Election, Voting Officials Say

    A lawsuit filed by the state attorney general Wednesday has the potential to slow down voting lines in what promises to be a staggering turnout for the Nov. 4 election, local voting officials said.

    "It will disenfranchise voters. That's what we're concerned about," City Clerk Maribeth Witzel-Behl said.

    Attorney General J.B. Van Hollen, a Republican, filed the lawsuit Monday in Dane County Circuit Court to get ineligible voters off the rolls. It calls for a court order mandating the Government Accountability Board to cross-check voters who have registered since Jan. 1, 2006, when federal Help America Vote Act legislation required that states implement a voter database to cross-check voter registrations with Department of Transportation, criminal and death records.

    "We're working on plans to make sure we don't have long lines at the polls, make sure that the lines can move smoothly and quickly," Witzel-Behl said. "If we throw this into the mix, then it is going to slow things down."

    The GAB didn't have the voter registration system up and running until Aug. 6 of this year and has said it will cross-check from that date on. Van Hollen said that to comply with federal law, the state has to go back to the federal deadline.

    Van Hollen spokesman Kevin St. John said Van Hollen wants the GAB to verify voters who registered by mail since Jan. 1, 2006, because they didn't have to show an ID.

    In a written response, Government Accountability Board Director Kevin Kennedy said the board is committed to preventing voter fraud, but Van Hollen's demands are too much, too soon.

    "The board believes it would be counter-productive to rush this effort and to create a significant risk, at best of unnecessary hardship and confusion at the polls, and at worst the disenfranchisement of Wisconsin citizens with a clear and legitimate right to vote," he said.

    If a judge rules in Van Hollen's favor, Witzel-Behl said city staffers would have to check 3,612 voters who registered by mail since the beginning of 2006. They have already processed 1,256 registrations that have been filed since the statewide database went online last month and have sent 100 letters to voters whose information didn't match and got 37 responses. The discrepancies typically come from names that are written differently on voter registration forms than on driver's licenses or driver's license numbers that are wrong or illegible.

    "A lot of it is us trying to decipher their penmanship," she said.

    Witzel-Behl said if Van Hollen's lawsuit prevails, the city will have to send letter to voters whose registrations are questioned, which the GAB has found to be more than 20 percent. The voters will have to clear up the discrepancies, and then the city has to run the information through another check.

    And as the election approaches, the phones at clerks' offices get busier, so people calling back to resolve discrepancies will be less likely to get through.

    "The closer we get to the election, the less time we have to clear things up," Witzel-Behl said.

    Diane Hermann-Brown, Sun Prairie city clerk, said the court needs to act quickly if it wants counties and municipalities to comply.

    "I don't think he's wrong on what he's doing," she said of Van Hollen. "It probably needs to get done. It just should have been done sooner."

    A status conference on Van Hollen's lawsuit is set before Dane County Circuit Judge Maryann Sumi on Sept. 19.

    "That only gives us 2 1/2 weeks before we run our poll books," Hermann-Brown said. "That's not enough time."

    If the court sides with Van Hollen, clerks are concerned voters who do not resolve the discrepancies will have to re-register at the polling place, leaving those behind them to wait.

    "I think we're expecting all eligible voters to appear on election day, and a lot of those have not yet registered," said Linda Cory, Fitchburg city clerk. "So in addition to that we would have to verify the ones prior. It's going to cause a lot of work. If that goes through, we'll have to staff extra people."

    Witzel-Behl said the net effect of the lawsuit, if it is successful, will be to discourage people from voting.

    "It's going to slow down the lines," she said. "And it will not only affect the people who have been flagged in the poll book, but the people who are standing behind that individual who have all come to the polls to vote."

    She said people might avoid Election Day problems by checking their own registration status at http://vpa.wi.gov.

    Election politics: Van Hollen's move has elicited howls from Democratic officials and progressive activists because many believe the people most likely to be flagged by the voter database will vote Democratic, in part because Democratic-aligned groups have done the lion's share of voter registration.

    State Democratic Chairman Joe Wineke said Van Hollen is "trying to distract and deny voters with fear-mongering."

    "This ploy by the Republican attorney general is nothing more than a waste of taxpayer dollars and a cynical attempt to disenfranchise eligible voters less than two months before the November election," he said in a press release.

    The Progressive group One Wisconsin Now called on Van Hollen to recuse himself from any legal action connected to the general election because his role as GOP presidential candidate John McCain's statewide campaign co-chair constitutes a clear conflict of interest.

    "McCain talks about country first," said Scot Ross, the group's executive director. "Van Hollen practices party first."

    St. John, Van Hollen's spokesman, said Van Hollen sees no conflict.

    "None of the critics had explained how or why compliance with federal and state election laws favors one party over another," he said. "Fair elections is not a partisan issue."

    State Republicans - harking back to August's investigation of several Milwaukee area voter registration workers caught falsifying registration cards while working for liberal groups - praised Van Hollen's move.

    "Van Hollen today lived up to an important campaign promise by standing up against the GAB to combat voter fraud," Reince Priebus, chairman of the state Republican Party, said in a press statement. "With voter fraud occurring earlier than ever this year, it was time to take real action and hold the GAB accountable."

What is becoming clear is that many democratic voters are vulnerable to technicalities built into the election apparatus, technicalities that in essence play an important role in significantly reducing the number of voters so that Republicans can win. The Republican party clearly lacks popularity as it is widely seen as corrupt and deceptive and as a party with few good ideas. Most Republican voters could care less about the country as a whole because they can't see beyond their oppressive, small ideas, which are essentially wedge issues such as abortion, God, family values, and sex education. In my view, these are personal issues that ought to be resolved within the family or with the help of some social organizations if affected families so desire. If Republicans want to ban abortion, then they should prevent it from occurring in their own families and stop trying to impose their so-called family values on others by using the government to outlaw Roe v. Wade. By reducing the voter rolls using these technicalities, Republicans are opposing the Constitutional right of vulnerable Democrats to vote. As such, this lawsuit effectively embraces an unconstitutional posture that permits voting only by less vulnerable citizens. Given this scenario, voting becomes a privilege rather than a right guaranteed by the Constitution. The power to ban Roe v. Wade may ultimately result from the use of unconstitutional laws that decrease voter rolls. Many of our judges are either already thoroughly corrupted or eminently corruptible and are thus likely to play on the side of the Republicans who are waging a war against the right of our most susceptible citizens to vote in order to increase their power to control all facets of this country. This effort to increase power and to become omnipotent at the expense of the Constitution needs to be stopped dead in its tracks.

I live in Milwaukee and plan to spend the day driving people to the polls and waiting there for them. We are a same sex couple, who grew up in WI, and we finally could not take it any more and we moved to Canada, because of hateful people like J B Van Hollen. The ONLY ones they care about are the white people in their economic class - nobody else! I am SO glad we are north of the border but watching and reading about all this just makes me want to cry. How sad that the US has fallen so far, with very little hope of recovery. See what they are like when their is anarchy in the streets and they are looking at each other, wondering what the heck happened. All they will have to do is look in a mirror for the answer.

This attorney general is a puppet of the right wing party. I own a local wisconsin business and when he won, a high ranking lawyer in town commented to me personally how STUPID this man is. He is a patsy of the Karl Rove clan and is using whatever means he has at his helm to disrupt democratic voters. This is a warning to other states...protect your right to vote. Our local liberal air america station (the MIC 92.1 in Madison WI) just uncovered an interesting ploy by McCain who is sending unsolicited absentee ballots to independent voters which directs them to the WRONG clerk of courts when voting and could disable their right to vote by the their sending the ballot to the WRONG clerk. More games.....more shame on the republicans.

Excuse me, it's good to hear all this outrage about a naked attempt at voter suppression, but has it occurred to anybody that this widespread campaign to challenge and cage voters might only be the smokescreen, the conjurer's mis-direction? This way they get voting rights advocates distracted from the fact that all those electronic voting machines out there can STILL be HACKED, like they were in 2000 and '04. Even the optical scan machines, that they had told us would be so secure. "Look, there's a paper trail!" Yet, if nobody demands, or can afford, a recount, the paper trail does no good. The electronic results stand otherwise. And they can be altered, with far less expertise than I would have suspected. The Michigan optical scan machines can be hacked in about 5 minutes, with 3 simple easily-concealed hand tools, and 1 "special" replacement data card. How do I know that? Is this some wild conspiracy theory? No! -There's a "HOW-TO" video of it, out on the web! Wake up, people! Not all the evil is done out in the open. Google it, educate yourselves, and then start bugging your governments about how they think they can secure this election. Time is short. Good Luck.

During the Christmas Holidays, people take trains, busses, planes, drive, whatever, to Washington DC, and demand Obama be placed in as president! What is encouraging is to read all your posts and know I'm not alone in my outrage and sadness. In my first 30 years of life in America, I never worried about the legitimacy of the vote, but since 2000 it has become more and more questionable. Compound that with a script made real called "fear of a black president", and I'm very anxious about this election. The recent surge in TV coverage of Palin is another deliberate Repub game-playing stunt where media is used to manipulate public opinion. I hope and pray Obama can continue to get his message across, and all citizen's votes are counted. If Repub corruption persists, we do have the right to revolt, to fight for what's right, and the far right definitely isn't.

Honest, decent republicans are scarce, I am sure. They can hide behind the Bible all they want to, but all I ever see coming from them is cool, calculated hatred, especially for the poor. And they are afraid of the poor, for their numbers are growing all the time, ironically thanks to Bush and his failed policies. These bullies will systematically attempt to wipe out all who are not white and wealthy. It may take many years, but I believe that is their agenda. They will be patient and steal election after election just to accomplish this. I tend to agree withthe poster: 'Another Peasant". Purging the rolls is one thing, but more of a smokescreen than anything else. Some states are trying to purge those who don't own property or have driving licenses, but that is patently illegal, and should not affect very many voters. If you want to vote in this election you MUST make the effort to register and be sure that you are registered to vote. Do it in person, and you virtually can not be denied. So many hapless poor are so depressed that they will not even make an effort to register and vote. Hey, it's FREE, you can do it. At the rate things are going, your life may depend on it. Don't think that your vote doesn't matter. The REAL danger in this election will be how the votes are counted, and THERE is where those who are educated and concerned should really be concentrating their efforts. There is no reason why the democrats shouldn't win a huge victory this November. Are there any organizations

Are there any organizations or groups actually going around the nation to check on possible voter fraud? This is my major concern for the upcoming election. The McCain/Palin Campaign is so loaded with obvious lies and blatant stupidity that I can't possibly imagine them winning an election, even with a charged up base. There aren't enough stupid Independents and undecided voters to fall for this kind of mediocrity. Is anyone out there checking to make sure we have an honest election? If not, why not?

Get ready the worst is yet

Get ready the worst is yet to come. The Republicans will do whatever it takes to win this thing. Some nasty Swift Boat ads are on the way against Obama. Palin is a rock star and will outshine stodgy looking insider Biden in debates, McCain has an eight point lead over Obama in Florida . . . things suck. I aint too optimistic. Obama should have made Hillary his running mate. I voted for Obama in the primary but am very disappointed that he did not choose Hillary for VP. Had he done so, he'd be a shoe-in. Now it's gonna take a miracle.

This all sounds uncannily

This all sounds uncannily similar to the last election in Ohio, when Ken Blackwell was both Attorney General and head of the campaign for W. He too, claimed there was no conflict of interest in the two roles. He then proceded to carry out a series of underhanded efforts to hand the vote over to Bush, including providing less voting machines to areas that tended to vote Democratic, locking up or destroying paper receipts after voting to impede recounts, and instigating last-minute challenges to voter registration efforts. It's sad to say it, but I'm with my mechanic, who recently said we needed to all get tricorn hats and follow the example of our founding fathers and mothers.

I know a few honest Republicans and they are either voiting for Obama or they are throwing away their vote on Ron Paul. MY own mom is a life-long Republican who hasn't voted Republican in years.

I am reading the blogs here and itis most informative. I was saying earlier in an emal that blogs can be so bad they make me want to throw up. It is time to change the situation at the voter booth for the better. How can we all collectively help the Wisconsin voters and otehr states as well? I am looking at all the states that are potentially corrupt to see waht is happening currently. I wonder how the local and state contenders are gong to do as well. Need to find out about campaigns in otehr states as well as here. And what are the economic conditions. I live on the west coast. We do mailin voting in Oregon. I can drive over to the election office as soon as I am able. Talk to them. Shake their hands. Ask how I can help. Take a booklet to study the issues and contenders. And vote. I do not need to wait until Nov. 4. And keep praying as well. A citizen for Peace and Prosperity for All

If this election goes as the past two have, I promise I will personally raise a ruckus that will be heard in Washington. The very thought of this team undoing the years of hard work that women have put in to get where we are today makes me physically sick. Answer: It's out of fear for what their own Party will do to traitors. In the right-wing blogs, the Repugs have said they vowed to destroy traitors within their midst. Either the GOP moderates "toe the party line," or their party's own membership of right-wing brethren appointed into many different positions of bureaucratic power in all government offices and businesses throughout the nation will arbitrarily and quietly place these moderate Republicans on their database "black list," (a.k.a "hit list") and disenfranchise these traitors into poverty, strip them of their rights, and impose upon them legal means, coercive obstruction and the use of threats to silence them from speaking out, as shall be their punishment for challenging the Will of "God's Own Party."

You know if this was a dem AG and he was trying to disenfranchise, say, a neighborhood full of oil barons, he would be shot and killed before he could file a lawsuit. There are no decent and honorable republicans left. McCain has made that obviously clear; he was supposed to be the decent one and we've seen how he's run his camp. What used to be decent republicans have quit voting entirely or switched parties. The rest are cheaters and liars, and they remain republican.
